So, What About the Clerk Who Won’t Issue Concealed-Carry Permits?

Throughout the online battles over Kim Davis, the counterfactual I’m most presented with is along the lines of the following: “You wouldn’t support or respect a clerk who refuses to issue concealed-carry permits, so why do you support Davis?” I have two thoughts in response. 

First, I do — in fact — respect genuine conscientious objections, even when I disagree. While I obviously wouldn’t agree on substance with the clerk’s stance on handguns and the Second Amendment, my response would depend to a great degree on the real-world effect of the clerk’s actions. If the situation is truly analogous to the Davis case, then I’d simply drive 20 extra minutes to get my carry permit then work to defeat the dissenting clerk in the next election. I may also try to impeach them (depending on the political environment). If I had no way to obtain a handgun without the clerk’s assistance, then the situation is dramatically different — necessitating immediate legal action with escalating penalties for noncompliance. Critically, however, jail is the last resort, not the first resort, for conscientious objection, and courts have broad powers to craft equitable remedies that vindicate constitutional rights without resort to imprisonment. In Kentucky, Judge Bunning’s focus was on punishing Davis, not granting marriage licenses.  


Second, while I generally respect conscientious objection, I reject the notions that all objections are equivalently meritorious. Indeed, American law has long distinguished among various types of conscientious objections, protecting some more than others. A state official who objects to protecting enumerated constitutional liberties is hardly in the same position as a person objecting to facilitating a “right” five justices created out of whole cloth (historically speaking) five minutes ago. If one can’t see the difference in those propositions, then we should just give up on public discourse entirely because reason and logic no longer matter. So, no, supporting Davis does not mean that I “have to” support any other clerk or government official who’s defying a court order. Give me their reasons, and I’ll give you my opinion.

Concealed Carry Permits For Women Up 270 Percent Since 2007

Leah wrote about some great news over the weekend regarding concealed carry permits. The Crime Prevention Center reported that the number of permits has increased since 2007–and the murder rate has dropped. The main reason is that President Obama has possibly become the greatest gun salesmen of all time (I may be exaggerating).
“The researchers found that the change in trends with regard to permits and gun sales is directly related to Barack Obama’s presidency. Simply put, the greater the push for gun control in the wake of several mass shootings, the more Americans head to the gun shop,” wrote Leah.
Before Noah Rothman went to Hot Air–he’s now with Commentary–he was atMediaite where he reported on a 2014 Applied Economics Letters’ study that showed between 1980-2009, “the results of the present study suggest that states with restrictions on the carrying of concealed weapons had higher gun-related murder rates than other states. It was also found that assault weapons bans did not significantly affect murder rates at the state level.”
Of course, liberals disagree, but regarding women and firearms the Crime Prevention Center noted another interesting find: women obtaining concealed carry permits rose 270 percent since 2007. Additionally, some findings found that minorities lining up for their concealed carry permit is increasing twice the rate of whites.
  • The number of concealed handgun permits is increasing at an ever- increasing rate. Over the past year, 1.7 million additional new permits have been issued – a 15.4% increase in just one single year. This is the largest ever single-year increase in the number of concealed handgun permits.
  • 5.2% of the total adult population has a permit.
  • Five states now have more than 10% of their adult population withconcealed handgun permits.
  • In ten states, a permit is no longer required to carry in all or virtually all of the state. This is a major reason why legal carrying handguns is growing somuch faster than the number of permits.
  • Since 2007, permits for women has increased by 270% and for men by 156%.
  • Some evidence suggests that permit holding by minorities is increasing more than twice as fast as for whites.
  • Between 2007 and 2014, murder rates have fallen from 5.6 to 4.2 (preliminary estimates) per 100,000. This represents a 25% drop in the murder rate at the same time that the percentage of the adult population with permits soared by 178%. Overall violent crime also fell by 25 percent over that period of time.
It’s confirmation of what’s been reported already; that women are lining up across the country for their concealed carry permits­–and now we have a percentage of that increase. They’re the next frontier in the gun industry, and even liberals are noticing that these ladies exercising their constitutional right to bear arms often “defy stereotypes.” Fancy that.

Surge in concealed weapon permits follows California court Second Amendment decision

Gun owners are flooding the sheriff's offices in two California counties with applications for concealed weapon permits following a bombshell ruling two weeks ago by a federal appeals court that citizens need not justify their requests.
Orange and Ventura counties have dropped the "good cause" standard for issuing conceal carry permits after the requirement was struck down  Feb. 13 by the U.S. 9th Circuit Court of Appeal. A three-judge panel of the court ruled 2 to 1 that the Second Amendment bars California counties from requiring law-abiding gun owners who want to carry concealed firearms to demonstrate special, individualized needs for protection.
More than 500 applications have poured in to the Orange County Sheriff’s Department in just two weeks — roughly the total number of applications filed in 2013, a spokesman said. Orange County Sheriff Sandra Hutchens announced on the department's website that the county will comply with the federal court's order immediately, sparking the wave of applications.

“We’ve received as many or more in the last week in a half than we did in the whole calendar year [of 2013],” OCSD Lt. Jeff Hallock told FoxNews.com by phone early Thursday.
He said Hutchens didn't wait for the decision to be further tested in order to "show respect to the court’s opinion while demonstrating her responsiveness.”
“For now, we’re going to accept applications with self-defense and/or personal protection as just cause,” said Hallock, adding that Hutchens is still encouraging applicants to submit a statement of good cause.
Similarly, in Ventura County, where officials also elected to immediately drop the "good cause" requirement, a tide of applications is expected.
“We’re certainly preparing for an influx of more applications,” Capt. Don Aguilar, spokesman for the Ventura County Sheriff’s Office, told FoxNews.com. “We’re getting calls from people who have questions about this.”
