[VIDEO] STEVE KING: IT’S NOT PERFECT, BUT TRUMP IMMIGRATION DOCUMENT ‘BOLD,’ STRONG,’ ‘POSITIVE’

 argued that GOP presidential candidate Donald Trump’s position paper on immigration is “bold,” “strong,” and “positive,” although he added, “I’d like to plug a couple more things in there” on Monday’s broadcast of CNN’s “New Day.”

King said, “Well, when I read through that document, in the end, I thought it’s a very, very positive document. It’s bold. It’s strong. It’s broad. It covers most of the things that you’d want to cover. I’d like to plug a couple more things in there.”
He continued, “But with regard to birthright citizenship, for example, it is — has constitutional underpinnings, yes, but the way you start that is, as you pass the legislation that puts an end to birthright citizenship, I happen to be the author of that legislation. And then it will be litigated, there isn’t any doubt about it, but there’s a clause in there thatsays, ‘and subject to the jurisdiction thereof,’ ‘All persons born [or naturalized] in the United States and subject to the jurisdiction thereof’ are American citizens, and — or are United States citizens, to be more technically correct. So, we have to start the legislation, I think it’s constitutionally sound to pass the legislation, and end birthright citizenship. There aren’t very many countries in the world that have that policy. But I was curious, for some time, about how Donald Trump would get Mexico to pay for the wall. As you know, I’ve advocated for a long time for a fence — a wall and a fence on the southern border. I’m optimistic about this. I think the tactics that he uses are legitimate, and he’ll use more leverage in that. … I think that he can get to that place, but whether they do or whether they don’t pay for the wall, as he says in his document, the cost of that wall pales in comparison to the cost of not building it.”
King was then asked why he isn’t pushing for criminal sanctions for employers who hire illegal immigrants. He answered, “I’m supportive of doing those things. The reason we haven’t pushed this harder in the last six and a half years is because, there’s no way that one can imagine that this administration is going to enforce any of that. I mean, they’ve gone to court to block local jurisdictions from even mirroring federal immigration law, let alone…how they’re accepting sanctuary cities, which I’m grateful that Donald Trump has in his document, he’s going to end that.” And “if you’re going to punish and fine employers, you have to have a Justice Department and an Obama [administration] — a presidential administration that’ll follow through. I would do that. But I think I have a better idea, and I was hopeful that it would be in this document. There’s room for it within the language that’s there, it’s not specified, it’s called the New IDEA Act. And that’s a piece of legislation that I offered, several cycles ago, that does this. It brings the IRS into play, and it tell — and it says this, ‘If you’re an employer, and you use E-Verify, you get safe harbor for those that you hire. But, you cannot be left the wages and benefits paid to illegals under this legislation.’ And so, the IRS would go through, under a normal audit of a business, and they would run the Social Security numbers of the employees through. If E-Verify kicks them out, and says, ‘Sorry, they can’t work in the United States,’ then the employer would lose his business deduction. So, your $10 an hour illegal, after there’s interest, penalty, and taxes charged on that, becomes a $16 an hour illegal. And we would — and there’s a six year statute of limitations on it. So, we would clean up this workforce, and we’d do so with the IRS. And we require the IRS to cooperate with the Social Security Administration, and the Department of Homeland Security. I know that’s within the — I’ll say within the list of things that Donald Trump would be looking at to support, but I don’t — but it’s not in the document. So, that’s what I would do. I think it’s actually — it enhances our revenue stream. It’s a — it would score out a plus by billions of dollars, and clean up our workforce.”
King concluded, “There’s something he’s tapped into here, and we — nobody knows how long this’ll last. We’ve never seen anything like this before, but he has tapped into the discontent in America, the malaise within America, the people who are fed up. They’re fed up with political correctness, they’re fed up with the disrespect for the rule of law, they’re fed up with the dilution of Americanism, and they want cultural continuity, they want English as the official language, they want free enterprise to be something we can proud of again, and they want to be done with an administration that’s been punishing big business. It’s important for all business to be profitable. That’s the engine that drives the freedom that we have. And there’s a robust America there, that needs to be tapped into. And that’s why I think he’s got the support he has, and why that helicopter landed a little ways away from me the other day.”

SSA Can’t Collect Overpayments Without Wasting Money


The Social Security Administration (SSA) spends more money than it collects when trying to recover payments to individuals who received benefits for which they were not eligible.
According to the Office of Inspector General (OIG), the SSA issued $128.3 million in “low-dollar” overpayments between 2008 and 2013, and then spent $323 million to collect them. The agency ultimately recovered only $109.4 million.
“This resulted in SSA spending over $213.6 million more than it collected,” the OIG said, in an audit released Wednesday.
The OIG defines an overpayment as “benefit payments greater than the amount to which individuals are entitled.”
The overpayments were distributed through the SSA’s Retirement and Survivors Insurance (RSI), Disability Insurance (DI), and Supplemental Security Income (SSI) programs. The SSA issued approximately $16.8 billion in disability insurance overpayments alone in the past decade.
“Generally, SSA attempted to collect overpayments regardless of the amount,” the OIG said. “In some cases, the value of the overpayment was less than what SSA spent to collect the overpayment. Therefore, for some overpayments, collection was not always cost-beneficial.”
A “low-dollar” overpayment is less than or equal to the agency’s average cost to retrieve an overpayment.
It cost the SSA an average $164.11 to collect each RSI overpayment, $268.32 for each disability insurance overpayment, and $56.63 for each SSI overpayment in 2013, according to the agency’s Cost Analysis System (CAS).
However, the OIG found errors within the accounting system. The CAS was not able to take into account SSI overpayments that took more than one step to recover. Some overpayments can take as many as five actions by the agency in order to get the money back, costing $283.15 for a single overpayment.
“Therefore, it is not possible to determine how much the average cost to collect an SSI overpayment in CAS is understated when multiple actions are required to collect an SSI overpayment,” the OIG said.
“The time and effort involved to identify an overpayment can vary greatly. Several factors affect how long it can take to identify the correct overpayment amount, such as the reason for the overpayment, how long the overpayment spanned, and whether there are auxiliary beneficiaries eligible on the record that may be affected,” they said.
The audit suggested the SSA could potentially have saved up to $3.2 billion if it was able to divert the millions it spent collecting low-dollar overpayments elsewhere, the OIG said.
The agency uses full medical Continuing Disability Reviews (CDRs) to determine if beneficiaries are in fact still disabled and eligible to receive benefits. By putting the $323 million into processing additional CDRs, the SSA could have reduced its backlog of 1.3 million beneficiaries awaiting reviews in 2013. Each review has a return on investment of $10 for the agency.
“However, the Budget Control Act of 2011 capped the amount of additional new budget authority SSA could use for CDRs and SSI redeterminations for FYs 2012 through 2021,” the OIG said. “Therefore, SSA had limited authority to use these resources for other workloads.”

Under Obama: Disability Trust Fund Runs Record 5 Straight Yrs of Deficits

(CNSNews.com) - In the fourteen fiscal years that preceded President Barack Obama’s inauguration in 2009, the tax receipts coming into the federal government’s Disability Insurance Trust Fund exceeded the benefits paid out, and the trust fund ran a surplus.
In each of the five fiscal years Obama has served as president, the trust fund has run a deficit as the number of people receiving disability benefits has surged. The Disability Insurance Trust Fund has never before run five straight years of deficits.
Barack ObamaIn fiscal 2013, which ended on Sept. 30, the Disability Insurance Trust Fund ran a record deficit of $31.494 billion, according to newly released data from the Social Security Administration. That followed deficits of  $8.462 billion in fiscal 2009, $20,831 billion in fiscal 2010, $25.264 billion in fiscal 2011, and  $29.701 billion in fiscal 2012.
From fiscal 1995 through fiscal 2008, the Disability Insurance Trust Fund ran surpluses, as receipts from the disability insurance taxes paid by people who were working exceeded the value of the benefits paid to those claiming disability.
Congress created the federal disability insurance program by adding an amendment to the Social Security Act in 1956. The government paid the first disability benefits in fiscal 1957.

American Workers Collecting Federal Disability Hits Another Record High


(CNSNews.com) - The number of American workers collecting federal disability insurance benefits hit yet another record high in October, according to the Social Security Administration.
This month 8,803,335 disabled workers are collecting benefits, up from the previous record of 8,786,049 set in September.
In February 2009, the first full month after President Barack Obama took office, there were 7,469,240 workers collecting federal disability insurance. Thus, so far in Obama’s term, the number of workers collecting disability has increased by 1,334,095. That works out to a net increase of about 29,646 per month (1,334,095 divided by 45 months), or an average increase of about 975 per day (1,334,095 divided by 1,369 days).
During George Bush’s eight years as president, the number of workers collecting federal disability insurance increased by 2,375,258, rising from 5,067,119 in February 2001 to 7,442,377 in January 2009. That equaled an average net increase of about 24,742 per month and 813 per day. In Bush’s second term alone, the number of workers on disability increased by 1,198,575, equaling an average monthly increase of about 24,970 and an average daily increase of about 820.

8,786,049: Yet Another Record for Americans Collecting Disability


One person in sixteen collecting Disability Payments
(CNSNews.com) - The Social Security Administration has releasednew data revealing that 8,786,049 American workers are collecting federal disability insurance payments in September. That sets yet another record for the number of Americans on disability.
The 8,786,049 workers taking federal disability in September is a net increase of 18,108 from the 8,767,941 workers who took federal disability in August.
Over the past 45 years, the number of American workers taking federal disability payments has increased four-fold relative to the number actually working.
In August 1967, 74,767,000 Americans were working (according to theBureau of Labor Statistics) and 1,152,861 were taking federal disability insurance (according to the Social Security Administration). That means that at that time there were about 65 Americans working for each worker collecting disability.
In August 2012, 142,101,000 Americans were working and 8,767,941 were on disability--meaning there were only 16.2 people working for each person collecting disability.
According to the Bureau of Labor Statistics (BLS), a record 88,921,000 Americans were “not in the labor force” in August. These were Americans who were at least 16 years old, who were not in the military or in an institution such as a prison or a nursing home, and who did not have a job and had not actively sought one in the last four weeks.
Also in August, according to the BLS, only 63.5 percent of the civilian population (those over 16, who were not in the military or in an institution) participated in the labor force. That was the lowest level of labor force participation in 31 years. To participate in the labor force a person must either have a job or at least be actively trying to find one.

Senate report: Quarter of Social Security disability benefits improperly awarded


The Social Security Administration improperly awarded disability benefits in more than 25 percent of cases examined between 2006 and 2010, according to a new Senate report -- potentially costing taxpayers millions of dollars.

The findings conclude an 18-month investigation by the chamber’s Permanent Subcommittee on Investigations and show that roughly a quarter of the 300 randomly selected disability cases were awarded benefits “without properly addressing insufficient, contradictory and incomplete evidence.” 

Each questionable decision can mean a big taxpayer expense. According to one estimate, the average lifetime disability award is $300,000. 

The investigation was led by Oklahoma Sen. Tom Coburn, a medical doctor and the subcommittee’s top Republican. He said the bipartisan report shows information gathered over the past several years concludes the Social Security Disability Insurance and Supplemental Security Income programs are “teetering on financial bankruptcy.”

The 136-page report focuses on questionable benefits rulings made by administrative law judges, including one in Oklahoma who was found to have awarded more than $1.6 billion in lifetime benefits in just three years. Judge Howard O’Bryan, in Oklahoma City, approved roughly 90 percent of more than 5,400 cases from 2007 to 2009 -- most of them held “on-the-record” without hearings, according to the minority report.

The report also found the agency since January 2009 added 5.9 million Americans to the disability rolls. And in 2011, 10.6 million people were receiving more $128.billion in disability insurance payments, the report said.

“The question is: Are benefits going only to those who are supposed to be getting to them?” Coburn asked Thursday during a Capitol Hill hearing on the issue. “The purpose of this program is to make sure that all Americans have a safety net if they become disabled and can no longer work. It should be remembered though that this law means ‘being unable to work any job in the national economy.’ ”

The Social Security Administration responded Monday, acknowledging the concerns and vowing continued improvement.

Illegal immigrants could reap more than $7B in tax credits this year, senator says

Illegal immigrants could receive more than $7 billion this year in federal tax credits, according to one estimate, thanks to a loophole in the law that allows people not authorized to work to reap the government payments with no questions asked. 

Sen. Jeff Sessions' office calculated that, based on recent trends, illegal immigrants could receive roughly $7.4 billion through a provision known as the Additional Child Tax Credit. That's more than quadruple what the payout was four years ago, but the payments have been steadily increasing over the past decade
. 
Though illegal immigrants are prohibited from receiving similar tax credits, a quirk in the law allows them to qualify for the child tax credit. And it's a "refundable" credit, meaning recipients can reap the money -- with average checks totaling about $1,800 -- even if they've paid no taxes.   

An aide to Sessions, R-Ala., the top Republican on the Senate Budget Committee, said the issue is a "serious matter that deserves attention" and another sign of how "Washington is disconnected from reality." 

Illegal immigrants can qualify because even people not authorized to work in the U.S. are supposed to file returns with the IRS. If they don't have a Social Security number, they are provided what's known as an Individual Taxpayer Identification Number in order to file returns. 

And those filers are not excluded from claiming the Additional Child Tax Credit, which is offered to some families with children under 17 years old. 

A report last year by the Treasury Inspector General for Tax Administration found the claims added up to $4.2 billion in 2010. Sessions' office calculated the $7.4 billion figure based on the IG report numbers and White House budget numbers. 

The IG report last year recommended that Congress pass legislation to "clarify" whether the tax credits should actually be paid to those not authorized to work in the U.S. 

Sessions co-sponsored a bill earlier this year to bar illegal immigrants from receiving the credit, but the bill was blocked from reaching the floor by Senate Majority Leader Harry Reid. 

Reid at the time said the bill targeted the children of low-income Hispanic families. 
Recent expansions to the credit under the stimulus law are set to expire at the end of the year.

GSA Employee Suspended for Campaigning for Obama While on Duty


The U.S. Office of Special Counsel (OSC) announced Friday the suspensions of two federal employees, including one from the troubled General Services Administration (GSA), for campaigning for President Obama from their offices.

In a press release, the OSC said a contracting officer from the GSA invited 23 people to an Obama fundraiser during the 2007-2008 campaign cycle from her government office while on duty. She also distributed Obama campaign material in the workplace and sent an email from her government account supporting his campaign.

The GSA, which oversees the business of federal spending, is still reeling from a stinging Inspector General report released earlier this year that detailed, among other things, a $1 million taxpayer-funded Las Vegas event.

The suspended GSA employee's alleged actions would violate the Hatch Act, which restricts the political activity of individuals employed or holding office in the executive branch of the federal government.

She has agreed to serve a 30-day suspension without pay.

A GSA spokeswoman said the agency supports the "aggressive action to ensure that all federal employees are adhering to the requirements of the Hatch Act." She noted employees "receive mandatory ethics training and weekly reminders about the need to comply with the Hatch Act."

The OSC also announced that a technology specialist for the Social Security Administration volunteered for a gubernatorial candidate's 2010 campaign. While on duty and in his federal office, the employee, "spent a significant amount of time coordinating volunteer efforts for the campaign" according to the OSC release. His activities included recruiting precinct captains, enlisting people to march in parades, organizing the distribution of yard signs and bumper stickers, and advising volunteers on how to host campaign events. The release said he invited over 50 people to the event and asked individuals to contribute $250 each. The employee will be suspended for 180 days without pay.
