Shutdown Blamed for Old Chemical Plant Security Lapses

The ranking Democrat on the House Energy and Commerce Committee has launched a comical theatrical campaign warning that the government shutdown is endangering the country because security standards at chemical facilities aren’t being enforced.

Here’s where the funny part comes in; the so-called security standards have failed miserably over the years and are rarely enforced, even when the bloated federal government is open for business. This has been documented in a variety of federal probes, including a recent audit that reveals the U.S. has for years been at risk of a bioterrorism attack because the agency responsible for securing thousands of chemical labs fails to do its job.

We’re talking about the Department of Homeland Security (DHS), the monstrous agency created after 9/11 to protect the nation from another terrorist attack. A DHS branch called Infrastructure Security Compliance Division (ISCD) is responsible for assuring that thousands of chemical facilities throughout the U.S. are secure under a special program known as Chemical Facilities Anti-Terrorism Standards (CFATS). This has not happened, according to several federal audits that date back to 2007. In fact officials have for years failed to develop national standards for lab design, construction and operation even though congressional investigators called for the standards more than three years ago.

Shamefully, this is not new, some 4,000 high-risk chemical facilities throughout the country have long been vulnerable to a terrorist attack because the government has failed to secure them. California Congressman Henry Waxman has chosen to lie to the American people to dramatize what he calls the “dangerous consequence of the Republican shutdown of government.” He actually claims that the government shutdown is making it impossible to enforce safety and security standards formulated to strengthen the ability of thousands of U.S. chemical facilities to withstand terrorist attacks.

This is partly because the failed CFATS program expired and as a result there are no legally binding regulations in place to protect the nation’s chemical facilities from criminal and terrorist attacks, says the ranking Democrat on the House Energy and Commerce Committee.  In a memo to fellow Democrats on the panel, Waxman’s true reason for even bringing this up surfaced: “The media has reported countless stories about the many hardships caused by the Republicans’ decision to close the federal government. The purpose of this memorandum is to describe one unfortunate and dangerous consequence that has received little attention.”

Buried in the last page of his memo is Waxman’s acknowledgement that the “CFATS program has had a troubled history of implementation” and that he and a fellow congressman have called for a “stronger and more effective program.” Nevertheless, letting it expire will have dangerous consequences, according to Waxman. “But whatever the flaws in the CFATS program, the answer is not to let the program sunset without any replacement, which is exactly what congressional Republicans have done. This state of affairs leaves dangerous chemical facilities unregulated and vulnerable to attack.” How could anyone possibly take this seriously?

Nevertheless, their rulers have demonstrated remarkable resilience in the face of bloody conflicts on their doorsteps, fast-growing populations at home, and modernizing forces from abroad.
One of the monarchies’ most visible survival strategies has been to strengthen security ties with Western powers, in part by allowing the United States, France, and Britain to build massive bases on their soil and by spending lavishly on Western arms. In turn, this expensive militarization has aided a new generation of rulers that appears more prone than ever to antagonizing Iran and even other Gulf states. In some cases, grievances among them have grown strong enough to cause diplomatic crises, incite violence, or prompt one monarchy to interfere in the domestic politics of another.
It would thus be a mistake to think that the Gulf monarchies are somehow invincible. Notwithstanding existing internal threats, these regimes are also facing mounting external ones -- from Western governments, from Iran, and each other. And these are only exacerbating their longstanding conflicts and inherent contradictions.

Poll: John F. Kennedy tops presidential rating

John F. Kennedy is shown. | AP PhotoAs the 50th anniversary of John F. Kennedy’s assassination approaches next month, polling released Tuesday as part of a new book about Kennedy’s legacy shows that he remains one of the most highly rated presidents of the past 50 years.

Asked to rate all the presidents from 1950-2000 on a scale of 0 to 10, Kennedy scored the highest, at 7.6. He was followed by Ronald Reagan, at 6.9, Dwight Eisenhower, at 6.8, and Bill Clinton, at 6.7. None of the other presidents scored above a 5.0.

Nevertheless, Kennedy would not be Americans’ first choice to bring back as the next president, if any former leader alive or dead could serve again. Asked who they would most want to bring back, 24 percent of adults chose Reagan, 21 percent chose Clinton and 13 percent chose Kennedy. Abraham Lincoln was next, at 9 percent.


The findings, from a survey of more than 2,000 adults conducted this summer, were released Tuesday to coincide with the release of a new book from University of Virginia political scientist Larry Sabato, which takes on evidence of popular conspiracy theories about Kennedy’s assassination and analyzes his lasting legacy.

At a press conference unveiling his book at the Newseum in Washington, D.C., on Tuesday, Sabato said it was the findings on the impact Kennedy’s life has had that most struck him, not the findings about his death.

“The most important thing didn’t have anything to do with the assassination, it was the fact that even though John Kennedy had a terribly abbreviated tragic presidency, he’s actually lived for 50 years through nine successors,” Sabato afterward told a handful of reporters, which included press from the U.K., Germany and Korea.



Filner guilty plea: Ex-San Diego mayor banned from public office

San Diego Mayor Bob Filner steps downSAN DIEGO -- Former San Diego Mayor Bob Filner on Tuesday agreed to give up most of his mayoral pension and never again run for office in exchange for avoiding jail time related to criminal charges that grew out of the sexual harassment allegations that drove him from office.
Under the plea agreement, Filner on Tuesday pleaded guilty to one felony count of false imprisonment and two misdemeanor counts of battery. The charges, filed by the state attorney general's office in San Diego County Superior Court, relate to three alleged victims, identified in court papers as Jane Doe 1, 2 and 3.
The felony count involves allegations of false imprisonment by violence, fraud, menace and deceit.
The count alleges that Filner used "undue" force to hold a woman against her will.
The battery counts involve accusations that he kissed one woman and grabbed another by the buttocks.
In addition to the agreement on running for office and his pension, Filner also agreed to spend three months in home confinement. He will also undergo treatment as “directed by a mental health professional” during his three years of probation.
The felony count could have brought a maximum sentence of three years in prison, each misdemeanor count a maximum of 12 months in jail.

Obamacare will double my monthly premium (according to Kaiser)

My wife and I just got our updates from Kaiser telling us what our 2014 rates will be. Her monthly has been $168 this year, mine $150. We have a high deductible. We are generally healthy people who don't go to the doctor often. I barely ever go. The insurance is in case of a major catastrophe.
Well, now, because of Obamacare, my wife's rate is gong to $302 per month and mine is jumping to $284.
I am canceling insurance for us and I am not paying any fucking penalty. What the hell kind of reform is this?
Oh, ok, if we qualify, we can get some government assistance. Great. So now I have to jump through another hoop to just chisel some of this off. And we don't qualify, anyway, so what's the point?
I never felt too good about how this was passed and what it entailed, but I figured if it saved Americans money, I could go along with it.
I don't know what to think now. This appears, in my experience, to not be a reform for the people.
What am I missing?
I realize I will probably get screamed at for posting this, but I can't imagine I am the only Californian who just received a rate increase from Kaiser based on these new laws.

MSNBC host Lawrence O’Donnell offered an uninformed characterization of the origin of the Washington Redskins mascot Monday on The Last Word. 
The MSNBC host alleged the name was “invented by white guys” in 1933:
LAWRENCE O’DONNELL: The name of the Washington football team was invented by white guys in 1933 when the team was then located in Boston. We don’t have notes from the naming session so we don’t know what else the team owner vetoed. Boston white skins? I doubt that made the list even though the team was very, very white. So what were the chances that the white guys in Boston in 1933 would come up with a racist term when thinking of people of different races? The chances were 100 percent.
However, according to Senior Linguist of the Smithsonian Institute Ives Goddard, the term “redskin” predates the 20th century and extends back to the colonial period. Moreover, according to Goddard, both members of the Native American community and whites used the term:
It was from the use of red as a conventional iconic reference to North American Indians, both by Native Americans and by representatives of the Colonial European powers, that the word redskin emerged. This development took place among a small group of people in a limited area, part of what was historically called the Illinois Country.
O’Donnell also claimed “we don’t have notes on the meeting,” but because the owners were white guys from Boston in the 1930s the odds of adopting a racist team name were high.

Ex-ACORN Operatives Helping Roll Out Obamacare

featured-imgA group formed from the ruins of ACORN is hard at work signing people up for ObamaCare, and may be collecting taxpayer cash for their work despite Congress' efforts to cut the organization and its affiliates off from government funding, a watchdog group charged.

The United Labor Unions Council Local 100, a New Orleans-based nonprofit, announced last month it would take part in a multi-state "navigator" drive to help people enroll in President Obama's health care plan. The labor council was established by ACORN founder Wade Rathke after his larger group was broken up amid scandal in 2009 and banned from receiving taxpayer funds.

“At a time when our government has ceased functioning due to an appropriations gap, it is ironic that America’s tax dollars are being doled out to an entity whose poor stewardship of our funds was well-established by Congress,” said Dan Epstein, executive director of Cause of Action, a nonpartisan watchdog group based in Washington.

The government has given out $67 million in Navigator grants to help with the controversial rollout of ObamaCare. It was not clear if Local 100 got a grant of its own, but it has set up a help center with Southern United Neighborhoods, a charity founded in March 2010 with many former ACORN members, to enroll people in ObamaCare. Southern United Neighborhoods received a Navigator grant of $486,123.

Mediaite’s Christopher asks dumbest question in history of White House press briefings [VIDEO]

On Tuesday, Mediaite White House correspondent Tommy Christopher added another chapter to his ongoing self-promotional crusade masquerading as a career in journalism.
And this time, it didn’t involve a shameless ploy to be an invited guest on whatever incarnation of Chris Hayes’ show MSNBC is currently airing.
During Tuesday’s White House briefing on Tuesday, Christopher, whose name isn’t really “Tommy Christopher,” asked a question about President Barack Obama’s health-care reform law that incorporated his personal experiences with health insurance after his 2010 heart attack
“First of all, I don’t if you’re aware of this, but when I had a heart attack three years ago, I was uninsured, and I haven’t been able to get insurance ever since then,” Christopher said. “Listening to all the pressure on the president to negotiate, a lot of it from inside this room, it made me think, is there a chance the president would be willing to delay Obamacare for a year if Republicans were to agree to delay heart attacks for a year?”
White House press secretary Jay Carney offered the obligatory Obama administration response.
“Tommy, you know the president’s position is that we need to implement the Affordable Care Act, and that when it comes to the millions of Americans across the country who have had a very hard time getting access to affordable health insurance, we need to focus on those folks and continue the business of implementing the Affordable Care Act so that on Jan. 1 those Americans will be able to purchase insurance, quality insurance at affordable rates for the first time,” Carney replied.
Carney went on to ask Christopher if his question had been answered, to which Christopher replied with yet another personal anecdote about Obamacare.
“Just for what it’s worth, I was able to enroll in the exchange about a week and a half ago,” Christopher said. “I haven’t picked a plan yet, though.”

White House press secretary Jay Carney told the assembled media on Tuesday that despite the horrific rollout of the federal government’s Obamacare healthcare exchange website, Secretary of Health and Human Services Kathleen Sebelius would not be fired.

“The secretary does have the full confidence of the president,” said Carney. Carney said that Sebelius had been told that the problems with the exchanges had to be “addressed.” Republicans haven’t been the only ones pushing for Sebelius’ ouster; former press secretary Robert Gibbs said that Sebelius should resign over the debacle

Consider for a moment what will come next for Obamacare, in the context of Ezra Klein’s five thoughts on the disastrous launch of the program – a bellwether of sorts for how the administration failed to live up to the expectations it sold to the law’s supporters and opinion leaders. There are a few different directions it can go from here, but the worst case scenario hasn’t really entered people’s consciences yet, in part because the insurers are staying quiet at the moment. The reality now is that the system is at least a month from actually working, and likelier two or (gasp) three, given the enormous range of problems. And that could make for a real disaster.
As it stands today, at most nine of the state exchanges are working… but while some systems are being announced as “fixed” on the state level, fixed in this case means the ability to look at plans, not to actually enroll. And the fundamental breakdown for the federal exchange hangs on a decision designed to insulate people from the true cost of plans – an approach which is now backfiring given the load it places on the website. The whole storyline is marked by a disturbing failure of basic technocracy: according to the New York Times, as late as the last week of September, HHS officials were still debating aspects of the site, including that requirement making customers register before shopping for insurance.

Former Army Capt. William Swenson is receiving the nation’s highest military award for heroism a little more than two years after Obama decorated Marine Sgt. Dakota Meyer in a pomp-filled White House ceremony. Swenson is the first living officer who served in the Afghanistan and Iraq wars to be awarded the honor and the 13th recipient of the medal in the two foreign conflicts.
Swenson, 34, of Seattle was nominated for his role in extracting U.S. and Afghan forces who were trapped in an ambush by some 60 Taliban hiding on the ridgelines and in a village at the end of the U-shaped valley. He then returned repeatedly to the battlefield – including for a final run with Meyer, two other Marines and an Afghan translator – to recover American and Afghan casualties under fire.
What’s extraordinary, however, is not only the two Medals of Honor and the slew of other decorations bestowed on American servicemen who fought at Gangjal, but also how the clash has been dogged by controversy from the moment it erupted on Sept. 8, 2009, to this very day.

How Much More Will Obamacare Cost This Business?

Larry Patterson will face up to a 72 percent increase in his costs if he wants to continue offering health insurance to his employees in 2014.
Patterson, a North Dallas businessman, operates a franchise called the Glass Doctor that repairs auto glass, windshields, windows, and shower doors. Because Patterson wants to attract the most qualified people to work for him and ensure their safety, he’s made sure to provide affordable health insurance options to all employees since inception.
But thanks to Obamacare, health insurance costs are set to skyrocket. When we met with Patterson in late September, he said his company was “frozen” waiting to find out if his ability to continue providing his employees affordable coverage was in jeopardy.
Now, just a few weeks later, Patterson’s worries are proving true. He received a letter from his insurance company that details high cost increases on the insurance he offers employees.
The letter detailed an 18 percent increase in premium costs for his annual health insurance renewal if he renews before the end of 2013. However, once the health insurer and reinsurance fees kick in, the increase will actually be 23 percent. This is on top of a 20 percent increase in 2011 when many of Obamacare’s provisions first kicked in.

Fitch has put the U.S. credit rating on negative watch, reports CNBC's Dominic Chu.
Fitch Ratings put the US government's "AAA" credit rating on 'rating watch negative' Tuesday, saying that the standstill on the U.S. debt ceiling negotiations risks undermining the effectiveness of the country's government and political institutions.
U.S. stock index futures fell.
"Although Fitch continues to believe that the debt ceiling will be raised soon, the political brinkmanship and reduced financing flexibility could increase the risk of a U.S. default," the rating agency wrote in a statement.
S&P 500 futures fell 9.6 points while Dow Jones industrial average futures sank 60 points and Nasdaq 100 futures fell 7.5 points. 
A Treasury Department spokesperson said the Fitch move reflected an urgent need for Congress to act on the debt ceiling.
Earlier today Senate Majority Leader Harry Reid lashed out at House Republicans, shortly after the collapse of a rival GOP proposal.
He warned at the time that the U.S. credit ratings could be downgraded as soon as Tuesday night.

‘What Are You Talking About?’ CNN Anchor Laughs at Dem Rep. for Linking GOP to Confederacy

CNN anchor Ashleigh Banfield ripped into and laughed at Rep. Charlie Rangel (D-NY) in an interview on Tuesday morning after he responded to a House proposal to open the government and raise the debt ceiling in exchange for changes to the Affordable Care Act by linking the GOP in Congress to the Confederacy. Rangel added that Republicans are overtly attempting to overthrow the government of the United States of America. 
“I’m certain that history is going to record that this is the lowest moment that we’ve had in the Congress,” Rangel said of the present state of negotiations between Congressional Democrats and Republicans.
“I get it,” Banfield agreed. “This whole thing has been embarrassing.” She repeated her question about just how palatable the new House GOP proposal is for Congressional Democrats.
“This isn’t a question of the House and Senate differing. This is not even a question about Republicans and Democrats differing,” Rangel replied. “This is all about a handful of people who got elected as Republicans that want to bring down our government.”
“The same way they fought as Confederates, they want to bring down the government and reform it,” he added.
“Whoa,” Banfield interjected. “I’m sorry. Are you likening — and I’m only assuming that you’re referring to the tea party members who are pretty intransigent on their views — are you liking them to Confederates?
“Well, I can tell you this, if you look at the states that they control, take a look at the Dixiecrats, see how they went over to the Republican Party,” Rangel replied.
Michele Bachmann is not from Dixie,” Banfield interrupted. “What are you talking about?”

reid101513 445x295 Reid Slams New House GOP Debt Limit OfferSenate Majority Leader Harry Reid, D-Nev., said Tuesday he was “blindsided” by news that House Republicans were moving forward on their own debt limit bill and “disappointed” in Speaker John A. Boehner, R-Ohio, for doing so.
Reid said on the floor that the new House GOP plan — which includes a number of Obamacare-related provisions and omits instructions for a budget conference — is “unproductive” and “a waste of time,” suggesting its only purpose was to cater to tea party conservatives and preserve Boehner’s speakership.
“I know I speak for many of us who have been working in good faith when I say that we felt blindsided by the news from the House, but this isn’t the first time. Extremist Republicans in the House of Representatives are attempting to torpedo the Senate’s bipartisan progress with a will that can’t pass the Senate … and won’t pass the Senate,” Reid said. “I am very disappointed with John Boehner, who would once again try to preserve his role at the expense of the country. I have worked hard to rise above partisanship, to find common ground in the Senate.”
Reid singled out a provision in the Senate-brokered bill to require a budget conference to produce a framework before Christmas. He called that a sign that senators are serious about tackling the larger fiscal issues that members of the House are not.
House Republicans had demanded a conference on a short-term continuing resolution as part of their post-shutdown strategy, but 15 days into a shutdown and two days before a default deadline, they apparently have little appetite for a larger bipartisan, bicameral negotiating group.
“For weeks, Republicans have claimed they want to negotiate, but their legislation completely ignores the need to work together to craft a budget and put our country on a fiscally sustainable path,” Reid said.
Reid’s comments were in line with sharp criticism from the White House, which released a strongly worded statement moments before Reid took the floor.

Palin: ‘Defaulting On Our National Debt Is An Impeachable Offense’

WASHINGTON (CBSDC) — Former Alaska Gov. Sarah Palin believes President Barack Obama should be impeached if he raises the debt ceiling without the backing of Congress.
In a Facebook post, Palin said Obama is “scaremongering the markets” on the prospect of default if the nation’s borrowing limit doesn’t rise by Oct. 17.
“Defaulting on our national debt is an impeachable offense, and any attempt by President Obama to unilaterally raise the debt limit without Congress is also an impeachable offense,” Palin said. “A default would also be a shameful lack of leadership, just as mindlessly increasing our debt without trying to rein in spending is a betrayal of our children and grandchildren who will be stuck with the bill.”
Senate Majority Leader Harry Reid and Senate Minority Leader Mitch McConnell are reportedly close to striking a deal that would fund the government through Jan. 15 and raise the nation’s debt ceiling through Feb. 15, according to CBS News. Even if the Senate does pass this legislation, it still must be approved by the GOP-controlled House.

On NPR Station, Dan Savage Whacks Mormons, Catholics for Belief That Sex Is Only for Making 'Zombie-eyed Followers for Jesus'

Tim Graham's pictureNPR has been a breeze beneath the wings of snarky gay advice columnist/MTV host Dan Savage on his book tour for “American Savage.” NPR White House correspondent Ari Shapiro hosted a book event in his hometown of Seattle. Now, Savage is denouncing traditional Mormons and Catholics on the NPR station KCPW in Salt Lake City.
The local NPR drone Ryan Cunningham wished him a happy birthday, and led him through a softball interview. Savage (inaccurately) trashed both Mormons and Catholics on this so-called network of civility for believing that sex is only for providing more “zombie-eyed followers for Jesus”:
NPR could say it was only one media outlet spreading the Gospel of Savage. The Salt Lake Tribune also published that scripted attack without any apparent attempt at fairness or balance:
"We’ve seen the Mormon church call off its dogs in marriage equality," he said in an interview before his speech. But he didn’t exempt the Salt Lake City-based LDS Church from his take on religion and sexuality, noting that sex has been around a lot longer than the Mormon church.

"Sex is for pleasure," he said, "and the Mormon church has always taken the position that sex is for creating more worshipful, zombie-eyed followers for Jesus."
Savage expressed hope to KCPW that “Increasingly, people are not willing to sacrifice their children on the altar of this dated dogma and this hateful ideology...It would be nice for the leader of the Mormon Church, as the leader of the Catholic Church seems to be doing, to draw a distinction between Mormon doctrine and civil law, religious law and civil law.”
