Tech at Night
Tech at Night is coming when it’s plenty light out this afternoon, because I need to start getting some sleep in preparation for my 25 hour broadcast as part of the Extra Life children’s hospital charity event.
The FCC got two new commissioners this week, a good one in Michael O’Rielly, and a likely bad one in Tom Wheeler. This came only after Ted Cruz got the answers he was looking for. Then again, under Barack Obama that’s the best we could hope for.
It’s very rare that I agree with a gun grabber like Dianne Feinstein but come on, she’s annoying the right people by calling out Snowden as the traitor he is.
Anyway, now that we have a new FCC Chairman, we can at least hope he’ll take on sensible goals. I won’t hold my breath, but we can hope.
Certainly a government that fails so badly to manage its own Internet projects shouldn’t seek to gain more power over the whole Internet.
Oh look, Bitcoin crooks stealing from other Bitcoin crooks. It turns out the drug runners of the Bitcoin community aren’t even cooperative with each other, but will instead rob each other.
It’s good to see a repudiation of the blame the victim approach that so many take these days with respect to copyright reform. One can think copyright is too long but still think the freeloaders online are parasites hoping that Atlas won’t shrug.
Sometimes patent reform is a thorny issue. I’m on record saying that software patents shouldn’t be targeted specifically for erosion, that patent trolls hinder innovation instead of helping it, and that the problem with patents is that too many bad ones are issued. Well, it turns out these principles are coming into conflict under the Democrats’ ill-conceived America Invents Act. I wish we could just repeal that whole law and make the problem go away, then deal sensibly with patent issues.

Congressman wants Justice Department to investigate raid on reporter’s home

A Republican congressman is calling on the Justice Department to investigate why state and federal law enforcement raided the home of a veteran investigative reporter and confiscated a stack of her confidential files in August.
“This is unbelievable,” Republican Texas Rep. Louie Gohmert said during remarks on the floor of the House this week. “This is happening in America.”
The Daily Caller broke the news last week that the confidential files of freelance journalist Audrey Hudson, a former reporter for the Washington Times, were taken by the Department of Homeland Security during a predawn raid of her Shady Side, Md. home on Aug. 6. The raid was carried out due to an unrelated criminal case.
On Tuesday, Gohmert read excerpts from that article on the floor of the U.S. House and expressed outrage over the incident.
“I would say that if the subpoena did not allow for them to take her notes pertaining to DHS whistleblowers that provided this reporter information, it begs the question that perhaps these law enforcement officers acting under color of State law or Federal law stole these without due process,” Gohmert said.
“It bears looking into,” he added.
But the Texas Republican expressed a lack of confidence that the Justice Department would actually investigate the incident and “do justice in such an abuse of power.”
“That doesn’t seem to be the case,” Gohmert said.

US 'spied on future Pope Francis during Vatican conclave'

The National Security Agency spied on the future Pope Francis before and during the Vatican conclave at which he was chosen to succeed Benedict XVI, it was claimed on Wednesday.
The American spy agency monitored telephone calls made to and from the residence in Rome where the then Archbishop Jorge Mario Bergoglio stayed during the conclave, the secret election at which cardinals chose him as pontiff on March 13.
The claims were made by Panorama, an Italian weekly news magazine, which said that the NSA monitored the telephone calls of many bishops and cardinals at the Vatican in the lead-up to the conclave, which was held amid tight security in the Sistine Chapel.
The information gleaned was then reportedly divided into four categories — “leadership intentions”, “threats to financial system”, “foreign policy objectives” and “human rights”.
At that time, Benedict XVI was Pope, suggesting that the Vatican may also have been monitored during the last few weeks of his papacy.

DEMOCRATS SCRAMBLE TO DISTANCE THEMSELVES FROM OBAMACARE

With the 2014 midterm elections just a year away, nervous Democrats have begun distancing themselves from what Health and Human Services Secretary Kathleen Sebelius now calls the Obamacare "debacle." 

"Our guys are frustrated by Obama's unforced errors," a Senate Democrat aide toldReuters on Wednesday. "How could the president not be ready for the rollout?" 
Rep. Rick Nolan (D-MN) expressed frustration last week with the Obama Administration's failed rollout of Obama's signature legislative achievement.
"Some of us, myself included, are somewhat resentful [and] upset about the apparent incompetency in designing and rolling this thing out," said Nolan. "Who was it that said we are going to go ahead knowing it doesn't work? I would fire that person."
The number four Democrat in the House, Rep. Xavier Becerra (D-CA), said, "I absolutely believe that somebody should be held accountable."
Other Democrats have now say they agree with Republicans that a delay of the individual mandate may be the only way to salvage the disaster and save face. 
"I think the administration is going to have to look at it [delay of the individual mandate]. and I'd encourage them to do so," said Rep. Gene Green (D-TX). 
Five Democrats have now asked for the Obama Administration to seek a refund from the contractors responsible for the Obamacare website fiasco. Reps. Ron Barber (D-AZ), William Enyart (D-IL), Pete Gallego (D-TX), Kyrsten Sinema (D-AZ), and Filemon Vela (D-TX) wrote a letter to Attorney General Eric Holder urging the reimbursement effort.
The Democrat defections come as conservative groups like Americans for Prosperity have poured an estimated $2 million into ad buys targeting Democrats in vulnerable districtswith messages highlighting their embrace of Obamacare.

Obamacare Live: Sebelius delivers SNL-like testimony

CNN, of all networks, captured the perfect representation of the total failure of the (Un)Affordable Care Act from concept, to content, to execution, to implementation in one powerful split screen graphic.
Health and Human Services (sic) Secretary Kathleen Sebelius testified Wednesday before the House Energy and Commerce Committee, bravely taking blame for difficulties accessing healthcare.gov.  CNN, along with other networks, covered the proceedings live.   While she denied the website ever crashed, CNN (CNN!) continued broadcasting the proceedings on half of the screen while the other half had a live screen shot of the website itself headlined with the oh so perfect, oh so truthful "The system is down at the moment."  And the site really was down all through her testimony.

No, that wasn't part of a Saturday Night Live skit, it was Obamacare live.  And not funny at all.


The unfunny Obamacare Live hearings skit continued.  Rep Cory Gardner (R-CO) persistently questioned her if she was purchasing insurance through the government exchange.  Practicing what he preaches, Gardner decided to live under the law and rejected his government insurance plan.  Sebelius didn't.  After all, she didn't have to, wasn't eligible, it is illegal.

My Advice to Californians; Get Out Now

If you live in California, I have a bit of advice. Get out now while you can afford the gas to load up the van and head north or east. You won’t be alone.

According to “Crazifornia: How California is Destroying Itself and Why It Matters to America”, about 150,000 Californians have been fleeing the state each year of late. “In fact,” wrote Laer Pearce, “Los Angeles alone has lost more households than New York, Miami, and, incredibly, the economically decimated city of Detroit…combined.”

The tide of traffic leaving the state is likely to increase. According to anews release from Earthjustice, one of the innumerable environmental organizations bent on destroying every form of energy that has fueled the growth of the American economy, the California Public Utilities Commission (PUC) has “finalized a groundbreaking decision to build innovative high-tech energy storagesystems that will lead California toward a future of clean, renewable energy and away from dependence on fossil fuels.”

You remember fossil fuels, oil, natural gas, and coal. The “clean, renewable” energies are wind and solar because, of course, the sun shines all the time and the wind blows all the time. Or not.

By definition, energy “storagesystems” can use mechanical, chemical, or thermal processes to store energy; these processes range from battery technologies to energystorage within compressed air or molten salt. If that sounds bizarre, it is.

According to Will Rostov, an Earthjustice attorney, “Clean, renewable energy sources will shapeour future, whether the dirty antiquated fossil fuels industry likes it or not, so it’s excellent to see California getting there first. It took years by environmental advocates and state regulators to reach this point.

Obama Praises Oregon’s Obamacare Enrollment Numbers . . . One Problem, They Have Enrolled ZERO People

 PORTLAND, Ore. (AP) — A month after Oregon’s problem-plagued online health insurance marketplace has failed to enroll a single person, concerns are mounting that some of the most vulnerable Oregonians may face a break in coverage if they don’t enroll within the next month and a half.

To date, the state has received just 4,260 paper applications as part of the national health care overhaul law, and the Cover Oregon website still can’t tell people what subsidies they are eligible to receive.

University of California president earmarks $5M to help students living in US illegally

SAN FRANCISCO — University of California President Janet Napolitano said Wednesday she is devoting $5 million to provide special counseling and financial aid for students living in the U.S. illegally, a move aimed at disarming critics who worried she would be hostile to the small but vocal student population.
The former Homeland Security Secretary announced the initiative in her first public address since she became head of the 10-campus university system a month ago — an evening appearance in San Francisco organized by the Commonwealth Club. She also pledged $10 million for recruiting and training graduate students and research fellows.
“Let me be clear. UC welcomes all students who qualify academically, whether they are documented or undocumented,” she said in prepared remarks released by her office before the speech. “Consider this a down payment — one more piece of evidence of our commitment to all Californians.”
Napolitano said the money would be used “to support these students with resources like trained advisers, student service centers and financial aid,” but did not immediately offer details about its source or possible conditions on its use.
University officials estimate that out of a total student population of 239,000, the system enrolls about 900 students who were brought into the country illegally as children, a group of immigrants known as “Dreamers” because of the stalled U.S. Dream Act that would give certain youth a path to permanent residency.
As part of a bill signed by Democratic Gov. Jerry Brown, California this year started allowing students who are not legal U.S. residents and are therefore ineligible for most types of federal financial aid to apply for state grants and scholarships.

Updated: Teacher Living In $400,000 Home Gets Obamacare Subsidies?




UPDATE: 7:04pm EST — I have confirmed the teacher mentioned in the ad lives in a home valued at around $400,000 USD.  Not too shabby. 
Today the White House and the Twitter #GetCovered campaign have unveiled a new poster touting “Gregg F” as the newest Obamacare success story.  It claims it lowered his rates to just $32/month.
So of course there are some problems with Gregg’s story.   First off, he’s a teacher and part of the teachers union.  Why aren’t they providing him with healthcare?
Well because he’s a substitute teacher, they’re keeping him to 30 hours a week more than likely so he doesn’t qualify for insurance under the Affordable Care Act.
Second problem is, Gregg got MASSIVE subsidies to fund this healthcare he has.  Oh and by the way, Gregg couldn’t figure out how to signup for this Obamacare thing either ….

Report: U.S. Deported Lowest Number of Illegal Aliens Since 1973

Total deportations of illegal aliens are at their lowest level since 1973, according to a new report released by the Center for Immigration Studies (CIS), debunking a claim by the Obama administration that deportations have hit an all-time high.
Jessica Vaughn, director of policy studies at CIS, obtained internal Department of Homeland Security (DHS) and Immigration and Customs Enforcement (ICE) data, for her report, “Deportation Numbers Unwrapped,” which was unveiled at the National Press Club on Wednesday.
“In 2011, the most recent year for which all ICE and CBP totals have been reported, deportations numbered 715,495,” the report states. “This was the lowest year since 1973, when 585,351 deportations were effected.”
Furthermore, total removals, a category of deportation that bars an illegal alien from returning to the United States, will reach 364,700 in 2013, the lowest level since at least 2008.
“This decline has to be of great concern to policymakers, and especially to the public,” Vaughn said. “It’s not as if there is a shortage of illegal aliens living in our country.”
“[The decline] is occurring at a time when ICE has better tools and more resources and more personnel than ever before,” she said. “So the number of removals really should be rising, but instead it’s falling.”
Enforcement activity has also declined in every ICE field office over the last year, with the largest drops occurring in Atlanta (62 percent), Salt Lake City (49 percent), Washington, D.C. (46 percent), and Houston (43 percent).
Interior enforcement is also down by nearly 40 percent since 2010.

A Real Halloween Scare By Charlie Daniels

When President Bush nominated John Roberts for Chief Justice of the Supreme Court and he was confirmed, I was extremely pleased as I believed him to be a man of integrity and common sense who would look out for the interests of the American people and defend the Constitution against all comers.
But with Judge Roberts's Obamacare Decision, evidently prompted by some arcane interpretation of semantics, he singlehandedly burdened three hundred and fifty million people with an unworkable, impractical, economy-destroying piece of legislation the slugs on Capitol Hill passed without even reading, the most nation-changing piece of socialistic corruption to come along in America's history.
For one man to wield this kind of power, to control the tie-breaking decision that will affect lives in this country for generations to come is a frightening and intimidating thing.
And when you stop and think about the power America has placed in the hands of the federal government, with no checks and balances, that can't in one way or another be manipulated by visible or invisible powers, it will dawn on you just how dangerous and freedom-threatening a clumsy, gluttonous, monolithic, central government really is.
Big government is cold, impersonal, always looking for ways to expand its power and control over our lives.

Bankrupt solar panel firm took stimulus money, left a toxic mess, says report

A Colorado-based solar company that got hundreds of millions of dollars in federal loan guarantees before going belly-up didn't just empty taxpayers' wallets - it left behind a toxic mess of carcinogens, broken glass and contaminated water, according to a new report. 
The Abound Solar plant, which got $400 million in federal loan guarantees in 2010, when the Obama administration sought to use stimulus funds to promote green energy, filed for bankruptcy two years later. Now its Longmont, Colo., facility sits unoccupied, its 37,000 square feet littered with hazardous waste, broken glass and contaminated water. The Northern Colorado Business Report estimates it will cost up to $3.7 million to clean and repair the building so it can again be leased.
“As lawyers, regulators, bankruptcy officials and the landlord spar over the case, the building lies in disrepair, too contaminated to lease,” the report stated.
"If a coal, oil or gas company pulled something like that the EPA would send out SWAT teams and the U.S. Marshals to track down the offenders, bankrupt or not."

The owner of the property tried to force a bankruptcy trustee to clean the facility, but the report said it would "place humans at imminent and significant health risk." One of the hazards is the presence of cadmium, a cancer-causing agent that is used to produce the film on the solar panels, the report said.
While the loan guarantees exposed taxpayers to hundreds of millions of dollars, the federal government lost a total of $70 million backing the failed company. Unsold inventory which should have been used to offset those losses, including 2,000 solar panels, mysteriously disappeared, according to theNational Legal and Policy Center.

VICE PRES. JOE BIDEN TO CNN: "We were under the impression that it was ready to go. We had the president, to his credit, almost seven weeks out was saying, 'is it going to be ready?' and to be told by the pros that, 'yeah, this is all ready to go, all in line.' Neither he or I are technology geeks and we assumed that it was up and ready to run, but the good news is that although it’s not, and we apologize for that, we’re confident that by the end of November it will be and there will still be plenty of time for people to register to get online."

[VIDEO] Krauthammer Reacts to Sebelius Testimony: ‘Pathetic, Horrible, Mortifying’

Charles Krauthammer reacted to Kathleen Sebelius‘ testimony before Congress today on Hugh Hewitt‘s radio show, calling it a “pathetic, horrible, mortifying performance” so colossally bad he almost felt sorry for her.
He did acknowledge Sebelius’ testimony was never going to be an easy ride. After all, as Krauthammer said, she “presided over the biggest debacle in liberal administrative history, and you’re into it for several weeks, you have no way out.”
He asked, “What in God’s name can you say?”
Hewitt agreed it was a “total disaster,” and Krauthammer admitted, “I almost felt sorry for her.”

NBC/WSJ poll: Obama approval sinks to new low

President Barack Obama’s approval rating has declined to an all-time low as public frustration with Washington and pessimism about the nation’s direction continue to grow, according to a new NBC News/Wall Street Journal poll.
Just 42 percent approve of the president’s job performance, which is down five points from earlier this month. By comparison, 51 percent disapprove of his job in office -- tied for his all-time high.

The NBC/WSJ pollsters argue that no single reason explains Obama’s lower poll standing. Rather, they attribute it to the accumulation of setbacks since the summer -- allegations of spying by the National Security Agency, the debate over Syria’s chemical weapons, the government shutdown and now intense scrutiny over the problems associated with the health care law’s federal website and its overall implementation.

Those events have combined to erase some of the advantage the president gained with polls showing most Americans blame congressional Republicans for the shutdown.

NBCUniversal’s Insurance Premiums to Rise Due to Obamacare

CNBC’s morning anchors were troubled by the news that their own insurance plans will become more costly under the Affordable Care Act (ACA).
On Oct. 30’s “Squawk Box,” CNBC Senior Correspondent Scott Cohn revealed details of NBC’s open enrollment, brandishing an official fact book outlining the process. He quoted the document, revealing that the ACA would increase employee premiums.
Cohn observed “Some of these costs, when you look at this, are way up -- double digits.”
Aetna Chairman and CEO, Mark Bertolini explained that “Aetna alone will pass through to its customers over a billion dollars of taxes and fees associated with the Affordable Care Act.”
Ironically, NBC has worked hard to promote Obamacare. In the week before the exchanges opened, NBC launched their own week-long campaign, to “help Americans get the most out of the Affordable Care Act.” NBC affiliate MSNBC was even more blatant in touting Obamacare.
According to the new health plan, “federally mandated health care changes will require Comcast-NBCUniversal to pay new fees and implement plan design changes that will contribute to the increased cost of our plans.”
These plan changes would also affect other NBCUniversal outlets like NBC and MSNBC.
