Judge orders Obama administration to release illegal immigrants from 'deplorable' facilities

A federal judge in California has ruled that hundreds of illegal immigrant women and children in U.S. holding facilities should be released, another apparent setback for President Obama’s immigration policy, according to The Los Angeles Times.

U.S. District Judge Dolly Gee said Friday that the conditions in which the detainees are being held are “deplorable” and violate parts of an 18-year-old court settlement that put restrictions on the detention of migrant children.

The ruling also raises questions about what the administration will do with the estimated 1,700 parents and children at three detention facilities, two in Texas and one in Pennsylvania.

Last year, tens of thousands of women and unaccompanied minors from Central America arrived at the Southwest border, with many believing a rumor that unaccompanied children and single parents with at least one child would be allowed to stay.

More than 68,000 of them were apprehended and detained while officials decided whether they had a right to stay.

Many were being released and told to appear at immigration offices until the administration eventually opened new detention centers.

Gee said in her ruling that children in the two Texas facilities had been held in substandard conditions and gave the administration until Aug. 3 to respond.

“We are disappointed with the court's decision and are reviewing it in consultation with the Department of Justice,” Marsha Catron, press secretary for the U.S. Department of Homeland Security, said in a prepared statement given to The Times.

Many of the Central Americans who crossed the Southwest border illegally last summer said they were fleeing poverty and escalating gang violence.

The Texas facilities are run by private companies, while the one in Pennsylvania is run by a county government.

In February, a federal judge blocked Obama's 2012 executive action to protect millions of undocumented immigrants from being deported.

And a federal appeals court in New Orleans refused three months later to allow the program to go forward, denying an administration request to lift the lower court decision.

Gee’s decision is also seen as a victory for the immigrant rights lawyers who brought the case.

The ruling upholds a tentative decision Gee made in April and comes a week after the two sides told her that they failed to reach a new settlement agreement as she had requested.

The 1997 settlement bars immigrant children from being held in unlicensed, secure facilities. Gee found that settlement covered all children in the custody of federal immigration officials, even those being held with a parent.

The Justice Department had argued it was necessary to modify the settlement and use detention to try to deter more immigrants from coming to the border after last year's surge. The department also said it was an important way to keep families together while their immigration cases were being reviewed, but the judge rejected that argument in her decision.

That means that the already stratospheric aggregate crime totals would be even higher if crimes by many illegal aliens who are not in the fingerprint database were included.

The Secure Communities initiative is an information-sharing program between the Department of Homeland Security and the Department of Justice. Presumably, both departments would have data on the number of fingerprint searches conducted that revealed a criminal act involved an alien.

Texas has been ground zero in illegal alien crossings into the United States.  The Texas DPS report shows that in the Rio Grande Valley, 154,453 illegal aliens were apprehended in 2013.

REPORT: 87 PERCENT OF ILLEGAL IMMIGRANTS TO REMAIN IN U.S.

An estimated 87 percent of illegal immigrants in the United States will not face a threat of deportation from the U.S. and have “a degree of protection” due to President Obama’s executive actions on immigration enforcement, the Migration Policy Institute concludes in a new report.

The MPI report, issued Thursday, highlights the impact of the new policy guidance on immigration enforcement on the estimated 11 million illegal immigrants in the U.S. — namely the Obama administration’s move to replace the Secure Communities program with the Priority Enforcement Program (PEP).

“MPI estimates that about 13 percent of unauthorized immigrants in the United States would be considered enforcement priorities under these policies, compared to 27 percent under the 2010-11 enforcement guidelines,” the report reads. “The net effect of this new guidance will likely be a reduction in deportations from within the interior of the United States as DHS detention and deportation resources are increasingly allocated to more explicitly defined priorities.”

MPI further estimates that the priority shift will reduce interior deportations from the U.S. by 25,000 annually.

It speculates that there are 1.4 million illegal immigrants with criminal convictions that would make them priorities for enforcement — lower than the 3 million MPI estimated under the 2010-201 guidelines.

“While much of the attention to the president’s executive action announcement has focused on the deferred action programs, which MPI has estimated could grant relief from deportation to as many as 5.2 million unauthorized immigrants, implementation of the new enforcement priorities is likely to affect about 9.6 million people,” Marc Rosenblum, report author and the deputy director of MPI’s U.S. immigration policy program, said.

The report comes as sanctuary cities are in the national spotlight following the murder of Kathryn Steinle, allegedly by a multiple deportee, multiple felon illegal immigrant who was released from custody due to San Francisco’s sanctuary policy of not honoring immigration detainers.

Administration officials have argued that PEP will help to encourage more sanctuary jurisdictions to comply with detainers. Republicans have had harsh criticisms of PEP saying it will result in more criminal immigrants in the U.S.

“By defining its ‘priorities’ to exclude large categories of illegal immigrants, including those who have already been ordered deported or those who illegally reenter after having been deported, PEP ensures that countless more dangerous aliens will be released into U.S. communities—allowing otherwise entirely preventable crimes, including some of the most violent and egregious, to occur,”

[VIDEO] FAMILIES OF LOVED ONES KILLED BY ILLEGAL ALIENS DEMAND AN END TO SANCTUARY CITIES

Several Americans who’ve had loved ones murdered by illegal aliens are calling on the Senate to end sanctuary cities and are recounting the agonizing losses they suffered thanks to lax immigration enforcement.

Witness Susan Oliver recounted, through tears, sheriff’s deputy Danny Paul Oliver’s violent murder. Oliver served in Sacramento County, a “sanctuary city” that protected the very illegals who killed him.

“He put himself into harm’s way every time he put his uniform on. And on Friday, October 24, 2014, my husband and father of two approached a car on his beat, but this time, it was the last time,” said Oliver. “The last thing my husband attempted to do as a POP [Problem-Oriented Policing] officer was to ask the man inside the car how his day was going. But he never made it to the driver’s window.”

“At about 10:30 a.m., that man was in the country illegal and armed with numerous illegal weapons. He aimed one out of the car from the parking lot of a Motel 6 at Sacramento and opened fire, killing my husband with a shot to the forehead,” she said with difficulty. “I can honestly say that not a day goes by where this has not effected me… Many people ask if I have gotten past that terrible day, and the answer is no.”

A twice-deported illegal alien from Mexico shot and killed two Sacramento officers, both Oliver and Sheriff Michael Davis Jr., while injuring another officer and innocent civilian during an October 2014 rampage.

He gave authorities a fake name when arrested, Marcelo Marquez, but U.S. Immigration and Customs enforcement determined his real name was Luis Enrique Monroy-Bracamonte. He had been deported back to Mexico in 1997 and 2001.

Report: 2.5 million illegal immigrants under Obama, 400,000 yearly

Some 2.5 million illegal immigrants have flowed into the United States under President Obama, with 790,000 rushing in since 2013, according to a new analysis.

Calculations from the Center for Migration Studies and the Pew Research Center indicate 1.5 to 1.7 million aliens joined the illegal population from 2009 to 2013 — either overstaying a temporary visa or sneaking into the country, according to a Center for Immigration Studiesreport out Monday morning.

The immigration watchdog's analysis of Census Bureau data also showed that an additional 790,000 illegals entered from the middle of 2013 to May of 2015, for a total of 2.5 million new illegal immigrants since Obama took office in January of 2009. That is a rate of 300,000 to 400,000 a year.

The issue has become explosive under Obama, especially in the last year when tens of thousands of children and young adults joined the regular flow of illegals from Latin America.

It has also embroiled the GOP presidential contest, with Donald Trump blasting Mexico and party leaders worrying about image of Republicans.

But the CIS report written by Steven A. Camarota, director of research, found that illegal immigration was higher under former President George W. Bush, potentially undermining the GOP's bid to sound tough on the issue. Under Bush, 500,000-600,000 illegals surged in a year.

Also, the report found that the overall population of illegals has remained "roughly constant," indicating that the surge in of immigrants is balanced by those going home or getting legal status.

Other points in the CIS report released Monday:

— Had the United States not allowed so many new illegal immigrants to settle in the country since 2009, the total number of illegal immigrants would have fallen by 2.5 million. But the arrival of so many new illegal immigrants offset this attrition in the illegal population.

— While the level of new illegal immigration is lower than a decade ago, the enormous ongoing scale of illegal immigration is a clear indication that the United States has not come close to controlling it.

— Prior research indicates that roughly half a million illegal immigrants return home on their own each year, are deported, die, or get permanent residence. Those who get legal status each year are not beneficiaries of the president's administrative amnesty known as DACA — which does not give permanent residence, but does provide Social Security numbers, work authorization, and identity documents. Rather it has been long-standing policy to allow those who violate immigration laws to still get green cards (permanent residency) if they qualify in one of the legal immigration categories such as marrying a U.S. citizen.

UCLA provides internship opportunities to illegal immigrants

Illegal immigrant students in California are actualizing their dreams this summer.

The UCLA Labor Center’s Dream Resource Center is allowing undocumented students to apply for Dream Summer, a ten-week summer program that provides paid internship opportunities for immigrants in California, regardless of their immigration or insurance status. The program will encourage them to advocate for immigration reform and promote universal health care access regardless of immigration status.

UCLA is among the growing number of University of California schools, including UC San Diego and UC Berkeley, to provide academic scholarships and opportunities for exclusively for illegal immigrants.   Tweet This

The Center says the program began in 2011 after the U.S. Senate failed to pass the DREAM Act in 2010, which would have given a path to citizenship to illegal immigrants who came to the United states before the age of 16. The program claims to have provided 418 internship opportunities to immigrant youth throughout the nation.

UCLA is among the growing number of University of California schools, including UC San Diego and UC Berkeley, to provide academic scholarships and opportunities exclusively for illegal immigrants, some of whom move on to become active spokesmen for immigration reform.

The US Census Bureau reports that as of July 1, 2014, Hispanics were the predominant ethnic population of California’s roughly 14.99 million residents. An estimated 68 percent of the state’s undocumented population is Mexican-born.

Seth Ronquillo, a spokesman for the Dream Resource Center, told the Daily Bruin, “Many of the participants in the program go on to become the leaders of the immigration reform movement. By working in social justice organizations, they are given the resources they need to continue in activism.”

For international students, the requirement is more stringent. “Students have to get credit for paid as well as unpaid internships to stay in the U.S. on an educational F-1 visa with approval from the Dashew Center for International Students and Scholars,” the Daily Bruin reports.

“I feel that UCLA as a public institution in California was established to educated the citizens of California as well as the U.S. and legal international students, not illegal immigrants. By only offering these paid internships to illegal immigrants UCLA is not only hurting law abiding citizens who are of all ethnicities including Hispanic, but they are also promoting and sponsoring people who are breaking the laws of our state and country. [This] is ironic since some of their funding comes from the state in which they are advocating for people to break this state's law,” Alexis Moran, a second-year Hispanic student at UCLA told Campus Reform,

California's Generosity To Illegals Is Crippling The State

California is once again leading the way in financial irresponsibility by subsidizing health care for illegal alien children, further burdening the state’s taxpayers.

The LA Times reports that the subsidized healthcare is a part of a $115.4 billion budget and would be available to 170,000 children at the age of 18 or younger. The cost is expected to be $132 million when fully implemented. The program will begin in May.

The Los Angeles Daily News features proponents of subsidized healthcare to illegal children saying that the state can afford to help low-income illegal children because California has billions of dollars in surplus.

Even if this were true, why does the burden have to be on us taxpayers? They are the ones who came here illegally. Yes, the children are here through no fault of their own but the sad reality is that children are often victims of bad circumstance through no fault of their own. For instance, if their parents are arrested for tax embezzlement, that’s not the children’s fault but we don’t reward the unlawful behavior of tax embezzlement as a result.

But the dirty little secret is that California is not as financially sound as the left would have you believe. In fact, the financial system is in dire straits, and a sizable portion is due to illegal immigration.

First, a little background: California would not be in this position if not for rogue, judicial activist judges. The people of California voted for Proposition 187 in 1994 by a vote of 59% to 41%, which prohibited illegal aliens from access to welfare programs, including public education and health care. This was back when Californians had common sense.

So naturally, as the left is wont to do when voter initiatives and legislation don’t go their way, they sued, hoping that a handful of judges in black robes would overrule the will of the people. And that’s what happened.

[VIDEO] Shooting renews scrutiny on 'sanctuary'-backing San Francisco sheriff

The murder of a young woman in San Francisco allegedly at the hands of an illegal immigrant has brought renewed scrutiny on the sheriff who released the defendant before the attack and has ardently backed policies making the city a “sanctuary” for undocumented immigrants. 

Immigration and Customs Enforcement officials in March handed over defendant Francisco Sanchez on a drug-related warrant to the San Francisco Sheriff’s Department.

However, the department released him several weeks later, after the charges were dropped, following a policy of not complying with federal requests to detain illegal immigrants for deportation.

"My long-held belief is that local law enforcement should not be in the civil immigration detainer business," San Francisco Sheriff Ross Mirkarimi said last year, after the policy was adopted.

Mirkarimi, a Democrat and former Green Party member, has argued since Sanchez allegedly shot to death 32-year-old Kate Steinle on July 1 that federal authorities should have issued a warrant or court order to hold Sanchez, who has seven prior convictions and has already been deported five times. 

But this claim has been met with skepticism, given the circumstances. “He should have honored the immigration hold,” immigration lawyer Francisco Hernandez told Fox News on Tuesday. 

Mirkarimi, elected in 2011, is up for re-election in November. Now, Steinle’s death, coupled with personal and departmental missteps, pose potential problems.

San Francisco 'Sanctuary' Killing: Why Is Our Political Class Letting Illegals Harm Americans?

Is reality about to intrude on America’s political class?  For at least the last two decades, that clerisy has assured us that immigration, legal or otherwise, is a virtue.  We’ve also been told that our lawless southern border is coming under control.

In his first year in office, President Bill Clinton said, “I believe we should stiffen our efforts to control the southern border.” He added “I think we should have more Border Patrol agents and I think we should do more to restrict illegal immigration.”

In a 2006 address from the Oval Office, President George W. Bush proclaimed that “the United States must secure its borders,” and said that “we are launching the most technologically advanced border security initiative in American history.”

President Obama said “When I took office, I committed to fixing this broken immigration system, and I began by doing what I could to secure our borders.”  The White House boasts that his subsequent efforts “represent the most serious and sustained effort to secure our border in our nation’s history.

AVERAGE 128 UNACCOMPANIED ILLEGAL MINORS DETAINED AT BORDER DAILY IN MAY

Each day some 128 unaccompanied alien children (UACs) were detained illegally entering the U.S. during the month of May, according to CNS News.

Customs and Border Patrol (CBP) data obtained by CNS for the month of July show that 3,965 children were detained in May— representing the single month with the highest level of UAC apprehensions this fiscal year.

The level of UAC illegal immigration to the U.S. is lower than the record highs of last year, but still much higher than years prior. As of June 1, Border Patrol had apprehended nearly 23,000 UACs at the Southwest border.

In response to last year’s massive influx of UACs the Obama administration moved forward with a campaign to dissuade — largely Central Americans — from attempting the dangerous journey north.

Included in the campaign was a program to fly qualifying children from Guatemala, Honduras and El Salvador to the U.S. as as refugees or parolees, in a program that has raised many serious questions.

“In effect, the President’s answer to the ongoing run on the border is to order government officials to transport many of those same individuals from Central America into the U.S. with lawful paperwork and guaranteed access to federal benefits,”

According to a recent report from the U.S. Citizenship and Immigration Services Ombudsman, as of April 23, 2015, the Refugee/Parole Program for Central American Minors (CAM) had received 565 applications with 439 applications for El Salvador, 114  for Honduras, and 12 for Guatemala.

Revealed: Feds predicted surge of illegals, see another 127,000 this year

Despite claims the administration was caught off guard, the White House and four Cabinet departments predicted last year's surge of at least 60,000 illegal juveniles over the U.S.-Mexico border and expect it to more than double to 127,000 this year, according to an internal document.

A 24-page administration PowerPoint for congressional appropriators dated April 22, 2014 bluntly stated that border arrivals of "unaccompanied alien children" would rise "by nearly a factor of 10" in 2014 to 60,000 and jump to 127,000 "if these growth rates continue." It is shown below.

Indications are that this year's surge won't meet that record number, but will be the second highest in recent history.

The document and accompanying graphs, provided by congressional sources, also set a price tag of $2 billion "to accommodate" the juveniles, some members of the MS-13 crime gang, this year.

The briefing counters claims by top federal officials that they didn't see the surge coming last year. President Obama called it an "urgent humanitarian situation" in seeking nearly $4 billion, and a top aide said it "was much larger than we anticipated."

It also indicated that the administration is changing its policy in handling the minors in a way that could expand the number allowed into the country, and is funnelling money to countries such as Mexico, Honduras, El Salvador and Guatemala to reverse the trend.

Recent reports show that most of the illegal immigrants allowed into the United States have skipped out on their immigration and deportation hearings.

The appropriations briefing was presented by the Office of Management and Budget and the departments of Health and Human Services, Homeland Security, Justice and State.

Shocked at what's in the PowerPoint briefing, Texas Sen. Ted Cruz fired off a letter to Health and Human Services Secretary Sylvia Burwell demanding answers raised in the briefing.

Cruz, a leading Republican presidential candidate, said that it appears the administration is deceiving the public about surge of kids. Referring to the 24-page PowerPoint, he wrote Burwell that it "raises significant questions about whether the administration has been truthful with the American people and Congress about its knowledge of the scope of the UAC problem."

Citing the 2014 prediction, which was nearly correct, Cruz wrote, "Far from being an unforeseen crisis, the high number of UAC that approached the United States-Mexico border last summer appears to have been calmly predicted."

WHO VOTED TO BRING 33 MILLION IMMIGRANTS NORTH?

Americans pride ourselves on being people who have a government. But these days, it more often seems as if we’ve got a government that has people.

And that government is even selecting who its people will be, having–within a generation–essentially imported a state’s worth of new people through immigration.

Since 1970, the number of “Hispanics of Mexican origin” in the U.S. has jumped from fewer than 1 million to more than 33 million. If all these Mexicans were a state, it would be the second largest in population in the country, trailing only California.

Did you vote to approve that immigration policy? Did anyone? In fact, the federal government allowed it to happen without any voter input. That’s by design.

In recent years, Congress has attempted to draft legislation to deal with illegal immigration. And while the controversial “Gang of Eight” bill passed the Senate in 2013, it died in the House after one of its authors withdrew his support. Immigration is a difficult topic, one that will require difficult discussions.

Instead, the Obama White House would prefer to short-circuit the political discussions.

“America cannot wait forever for them to act. That’s why today I am beginning a new effort to fix as much of our immigration system as I can on my own, without Congress,” President Obama warned last summer. After the November elections, he acted to grant amnesty to millions of illegals.
