NYT: Obama Exempts ObamaCare from Fraud Prosecutions

WASHINGTON — The Affordable Care Act is the biggest new health care program in decades, but the Obama administration has ruled that neither the federal insurance exchange nor the federal subsidies paid to insurance companies on behalf of low-income people are “federal health care programs.”

The surprise decision, disclosed last week, exempts subsidized health insurance from a law that bans rebates, kickbacks, bribes and certain other financial arrangements in federal health programs, stripping law enforcement of a powerful tool used to fight fraud in other health care programs, like Medicare.

The main purpose of the anti-kickback law, as described by federal courts in scores of Medicare cases, is to protect patients and taxpayers against the undue influence of money on medical decisions.

Kathleen Sebelius, the secretary of health and human services, disclosed her interpretation of the law in a letter to Representative Jim McDermott, Democrat of Washington, who had asked her views. She did not explain the legal rationale for her decision, which followed a spirited debate within the administration.

Dem: GOP eyes 'impeachment circus' to thwart Obama agenda

Rep. Jim McDermott (D-Wash.) says congressional Republicans are planning an "impeachment circus" to thwart President Obama's legislative goals on the economy and immigration reform.

"It's like a magician who snaps his fingers in one place so you won`t see what he`s doing with his other hand," McDermott said Friday during an appearance on MSNBC. "They are basically trying to keep the president from doing anything on jobs or on immigration or on climate change or any other issue that the American people are facing or pensions or anything."

The former House Ethics Committee chairman said that Republicans would turn to the impeachment strategy after they were unsuccessful in using the debt ceiling and government shutdown as leverage to dismantle ObamaCare.

"They've run the let's run the country over the cliff strategy and that didn't work. And so now back at the second one of the Republican strategies. That is let`s impeach the president," McDermott said.

The Washington Democrat warned that "as long as they can keep this impeachment circus going, nobody will pay any attention" to more substantive policy issues.

Rep. Jim McDermott (D-olt): Republicans Scared Of Obamacare Because It’s Such An Awesome Law…

Rep. Jim McDermott, Washington Democrat, argued Wednesday morning that the real reason Republicans are so zealous in their attempt to repeal or defund President Obama’s health care law is that they’re afraid voters will like it once it’s implemented — and will see Mr. Obama as having made it happen.

The president needs to fight as he’s never fought before right now on health care, Mr. McDermott said on C-SPAN’s “Washington Journal.”



“If they lose this one, it’s over,” he said.
Mr. McDermott said that in comparison to Republicans in the 1960s, many of whom opposed President Lyndon B. Johnson’s push on Medicare but still helped implement it, “they have fought from the very first against improving” the health care bill today.

Many Republicans, however, have said that the law is simply not salvageable. Sen. Marco Rubio of Florida said an attempt to defund the law is now the only option left.

“This is the only chance and the last chance that we have,” Mr. Rubio said on Fox News’ “The O’Reilly Factor.” “And the one thing that does bother me is that there [are] people in Washington that love to say, ‘We’re against Obamacare.’ How can you be against Obamacare but vote for a budget that funds its implementation when you know the harm that it’s going to do?

“Now I would much rather the president come down from his prideful position and basically say, ‘Look, the law is messed up.’ But he’s not going to do that obviously, and so this is the only option.”
