Dick Morris: Oklahoma Suit May End Obamacare

Image: Dick Morris: Oklahoma Suit May End ObamacarePolitical pundit Dick Morris believes that a suit brought by Oklahoma against Obamacare could be what ultimately knocks down the president's healthcare law.

"Why didn't anyone else think of it?" Morris wrote in The Hill.  "Unlike the suit brought by 26 state attorney generals, this suit does not make a constitutional objection to the Affordable Care Act. Instead, it uses the language of the law to challenge the elaborate system of subsidies, tax credits, and individual or employer mandates and fines the act has spawned."

The suit, filed by Oklahoma's Republican Attorney General Scott Pruitt, was published in the Case Western Reserve School of Law Journal. The article contends that the wording of the Affordable Care Act only allows a subsidy for health insurance for those who got their coverage through state exchanges rather than the federal exchange.

"The IRS has ruled that the language of the statute should be 'interpreted' to extend the subsidies to those enrolled in state or federal exchanges, but that's not what the law says," Morris explained, adding, "Section 1041 of the act, according to their article, 'authorizes premium-assistance tax credits and makes them available only through state-run exchanges.'"

It also says tax credit can only be given if the taxpayer has a plan that was enrolled in through an exchange established by the state under section 1311 of the Affordable Care Act.

"Adler and Cannon argue that 'by its express terms, this provision only applies to exchanges 'established by a state' and 'established…under Section 1311,'" Morris pointed out.

Morris argued that the IRS and supporters of Obamacare try to "stretch the language to imply a mandate to cover those in federal exchanges."

Obama Hit By Storm Backlash


Natural disasters usually follow the same political trajectory: First the incumbent experiences a bounce as he tours the impacted area, shows his concern, and pledges help to his beleaguered constituents. But then reality sets in and the shortages, delays, mishaps, deaths, and devastation becomes apparent and people turn against the incumbent.
George W. Bush had his Katrina.
And now Barack Obama has his Sandy.
Last week, Obama asserted a kind of ownership of the storm by touring New Jersey in the now infamous embrace of Republican stalwart Governor Chris Christie. Now that we are all appalled by the lack of food, gas, water, heat, and the basic essentials of life throughout the storm zone, Obama’s government doesn’t look so good anymore.
Why didn’t FEMA stockpile food, water, and gasoline? We had a week’s notice to prepare for Sandy. There was no shortage of time. Did the government not realize that people needed to eat, drink, and drive?
All throughout America, we are asking these questions of our television sets as we watch the evolving story of human misery.
Meanwhile, Obama has resumed the campaign trail, pounding the opposition in the same relentless and partisan style which he used before the storm. When Obama said that voting was “the best revenge,” he threw away whatever presidentiality he displayed in touring storm damage earlier in the week.
As he entered the last week before the Congressional election of 1994, President Clinton returned to the U.S. after having presided over the signing of a peace treaty between Israel and Jordan. He called me on his return and asked where he should campaign? Which incumbent Democrats should he try to help get re-elected?

Dick Morris: Why The Polls Understate Romney Vote


Republicans are getting depressed under an avalanche of polling suggesting that an Obama victory is in the offing. They, in fact, suggest no such thing! Here’s why:
1. All of the polling out there uses some variant of the 2008 election turnout as its model for weighting respondents and this overstates the Democratic vote by a huge margin.
In English, this means that when you do a poll you ask people if they are likely to vote. But any telephone survey always has too few blacks, Latinos, and young people and too many elderly in its sample. That’s because some don’t have landlines or are rarely at home or don’t speak English well enough to be interviewed or don’t have time to talk. Elderly are overstated because they tend to be home and to have time. So you need to increase the weight given to interviews with young people, blacks and Latinos and count those with seniors a bit less.
Normally, this task is not difficult. Over the years, the black, Latino, young, and elderly proportion of the electorate has been fairly constant from election to election, except for a gradual increase in the Hispanic vote. You just need to look back at the last election to weight your polling numbers for this one.

Dick Morris: Obama Thugs Rough Up Gallup For Polls They Don’t Like


The Obama Administration’s Justice Department announced, on August 22nd, that it was joining a lawsuit by a former Gallup employee and whistleblower against the Gallup Corporation for allegedly overcharging the government on polling work.
The announcement comes on the heels of a confrontation between Gallup staffers and Obama strategist David Axelrod in which he accused the company of using out of date sampling methods which, he said, generated polling data negative to the president.
The whistleblower’s lawsuit has been kicking around since 2009, but the Justice Department joined the suit only after the run-in between Axelrod and Gallup in April of this year.
In a scene right out of a typical authoritarian regime, Fox News reports that “employees at the venerable Gallup polling firm suggested they felt threatened by Obama campaign adviser David Axelrod when he questioned the methodology of a mid-April poll showing Mitt Romney leading the president – according to internal emails published Thursday.”
That poll that sent Axelrod ballistic showed Romney leading Obama 48-43 percent.
The Daily Caller published e mails that started when Axelrod sent a tweet to Gallup saying the tracking poll was “saddled with some methodological problems” and directing followers to a National Journal story in which a professor suggested outdated sampling.
According to the email chain titled “Axelrod vs. Gallup,” the White House in addition asked that a Gallup staffer “come over and explain our methodology,” which was apparently perceived as a subtle threat.
Fox News reported that “a Gallup official said in an email he thought Axelrod’s pressure ‘sounds a little like a Godfather situation.’”
Gallup refused to change its methodology to suit the White House.
And the Justice Department intervention in the whistleblower suit came three months later. The whistleblower, Michael Lindley, claims that Gallup violated the False Claims Act by overcharging the federal government for its services to the U.S. Mint, the State Department and other federal agencies. The Justice Department plans to add Gallup’s work with FEMA to the list of alleged overcharges covered in the lawsuit.
Lindley charged that Gallup overestimated the number of hours of field work that the government surveys would require and that it billed the feds based on the inflated estimates.
According to the Washington Times, Lindley worked for the Obama campaign in 2008 as an Iowa field organizer based out of Council Bluffs, Iowa.
As the election progresses, this blatant effort to influence Gallup’s data and its poll numbers is an example of Chicago political thugs at their worst.
