15 States Finally Standing Up Against Obama’s Unconstitutional Regulations


Fifteen State Attorney Generals have filed suit against Obama’s Environmental Protection Agency for their sweeping and unconstitutional carbon regulations.

The fifteen states who petitioned the court on Thursday are West Virginia, Alabama, Arkansas, Florida, Indiana, Kansas, Kentucky, Louisiana, Michigan, Nebraska, Ohio, Oklahoma, South Dakota, Wisconsin and Wyoming.

If you are like me, you are wondering where your state is in the list.

The Blaze reports that under the unconstitutional regulations, the EPA will “regulate the electricity industry and require states and utility companies to meet goals, providing rewards and penalties.”
EPA spokeswoman Liz Purchia told Reuters, “To ensure that the Clean Power Plan’s significant health benefits and progress against climate change are delivered to all Americans, EPA and the Department of Justice will vigorously defend it in court.”

Fine, but you have no constitutional authority to do so.

West Virginia Attorney General Patrick Morrisey said, “This rule is the most far-reaching energy regulation in the ... to transform itself from an environmental regulator to a central planning agency for states’ energy economies. The Clean Air Act was never intended to be used to create this type of regulatory regime, and it flies in the face of the powers granted to states under the U.S. Constitution.”
The attempt by the states could be more easily dismissed through nullification of EPApolicies, since they are not even law and since the EPA is an unconstitutional agency. However, something had to be done immediately.

“If we were to wait on the EPA to get this rule published, it could be well into 2016 before the States complete arguments and receive a ruling on a request to stay this rule,” Attorney General Morrisey said. “By that time, many states will already be in the middle of drafting their compliance plans ahead of the September 2016 deadline. We want to ensure that no more taxpayer money or resources are wastefully spent in an attempt to comply with this unlawful rule that we believe will ultimately be thrown out in court.”

“While this request is not typical, the EPA is playing games by putting the risk of a delay in publication entirely on the states,” Morrisey added. “We hope the court will spare our states any more unnecessary harm, and that the EPA will not needlessly delay the publication date.”

Of course, Barack Obama, being the Marxist that he is, called the unconstitutional measures “the single most important step the U.S. has ever taken to fight climate change.”

The problem is that there is no climate change. There is no global warming. All of this is false science in order to extort money from the American people, impose communism inAmerica, shutdown business and eventually control the people.

“This is one of those rare issues because of its magnitude, because of its scope, that if we don’t get it right, we may not be able to reverse it,” Obama said. “There is such a thing as being too late when it comes to climate change. That doesn’t mean it’s hopeless. We can take action.”

The problem is that men do no create the weather or change the climate. God does. He determines how far the seas go (Job 38:8-11) and how hard the winds blow (matt 4:39). Yes, even hurricanes, tempests and such are at His command. Climate change is nothing more than a ruse. It is a lie because it comes from those whose father is the father of lies (John 8:44), the devil.

It’s long past time that states began to start banding together to ignore, not go to court with, the federal government in matters like this. Furthermore, they should ignore the court’s ruling, which is just that (ie. A ruling), and begin nullifying and interposing themselves between citizens, businesses and other entities in the states and the federal government.

Better yet, why don’t we simply band together to eliminate the federal government altogether and go back to sovereign states and Articles of Confederation. That would eliminate much of the tyranny that is strangling us today.

[VIDEO] We Now Know Where Lois Lerner's Emails and Backup Tapes Were Destroyed

There have been dozens of questions surrounding the disappearance of emails belonging to former IRS official Lois Lerner, the woman at the center of the IRS targeting scandal. Some of Lerner's emails have been recovered, after IRS Commissioner John Koskinen said under oath they were lost forever. Thousands are still missing. But perhaps the most compelling questions that have been asked since the IRS targeting scandal broke in May 2013 are 1) Exactly where were Lerner's emails and backup tapes destroyed? 2) Who destroyed them?
Now, we have an answer. According to Americans for Tax Reform, Lerner's hard drive was destroyed by the IRS "Midnight Unit" in West Virginia: 
Backup tapes containing as many as 24,000 Lois Lerner emails were destroyed by an IRS entity officially known as the "Media Management Midnight Unit" located in Martinsburg, West Virginia, according to documentation released this week by the House Oversight Committee. In all, 422 backup tapes holding the emails were magnetically "degaussed" despite an agency-wide preservation order and congressional subpoena. Degaussing is a process whereby powerful magnets are used to erase data on a storage tape.


The preservation order came from IRS Chief Technology Officer Terence Millholland in response to Congressional subpoenas over Lois Lerner's emails. However, the agency completely failed to ensure the order was followed or understood. According to the House Oversight report:

-"The IRS failed to ensure compliance with the preservation order at each turn. The IRS failed to confirm compliance with the preservation order in February 2014, upon learning of the gap in emails; failed to ensure the Media Management Midnight Unit, the team that destroyed the backup tapes, properly understood the preservation order; and failed to make certain that individuals who ordered the destruction of the specific media, in this instance the backup tapes, properly understood the preservation order."
Keep in mind Lerner's hard drive didn't simply "crash" on its own, but instead hadphysical damage. According to one Treasury Inspector General, the hard drive likely crashed due to "an impact of some sort." The question is who damaged the hard drive and whether it was done on purpose to destroy evidence.
New documentation released by the House Oversight Committee this week again raises questions on how Lois Lerner's hard drive was physically damaged and whether there was some kind of deliberate act to destroy data on it.


The House Oversight Committee report cites an officially transcribed interview with John Minsek, senior investigative analyst with the IRS Criminal Investigations (CI) unit. Minsek examined the Lerner hard drive in 2011. In the transcribed interview, he notes Lerner's hard drive contained "well-defined scoring creating a concentric circle in the proximity of the center of the disk." 
Earlier this week a federal judge threatened to "haul into court the IRS Commissioner to hold him personally into contempt," for ignoring court orders and refusing to turn over emails belonging to Lerner by deadline.

WV DEMS EXEMPT STAFF FROM MINIMUM WAGE HIKE

Last week, the Democrat controlled House in West Virginia passed legislation raising the state's minimum wage to $8.75 an hour, $1.50 higher than the federal minimum wage. The action is part of a nation-wide effort by Democrats to make a minimum wage increase central to their platform for the midterm elections. The increase didn't effect all workers, though. Democrats exemptedmany of their own staff from the wage hike. Businesses may have to pay the higher wages, but the legislature will avoid many of the consequences. 

From the legislative text, the wage hike doesn't apply to:
(18) any person employed on a per diem basis by the Senate, the House of Delegates, or the Joint Committee on Government and Finance of the Legislature of West Virginia, other employees of the Senate or House of Delegates designated by the presiding officer thereof, and additional employees of the Joint Committee on Government and Finance designated by such joint committee;
In other words, the legislative leadership can designate employees whom won't qualify for the minimum wage increase. If only small businesses had such an option.
In fact, the Democrat's minimum wage hike carves out exemptions for 19 different classes of employees. The wage hike doesn't apply to handicapped workers, seniors, state fire fighters, movie ushers, newspaper deliverymen, summer camp workers, college students, etc. 
There are economic reasons for exempting these workers from a wage hike. That the Democrats would push these exemptions, though, is at least tacit acknowledgement that minimum wage increases have negative economic consequences. The Democrat legislators themselves recognize that they would have to reduce employment if they had to comply with the wage hike. 
These 19 exemptions betray the political aspect of the Democrat's push for a wage hike. Businesses should do what they say, not what they do.

Obama’s energy nominee in danger of defeat

Two key senators said Wednesday they will vote against confirming Ron Binz to be chairman of the Federal Energy Regulatory Commission, dealing what could be a fatal blow to President Obama’s pick for the obscure but powerful panel.

Sen. Joe Manchin III, West Virginia Democrat, said Mr. Binz’s attitude toward coal and natural gas is too dangerous for his state’s economic health, and Sen. Dean Heller, Nevada Republican, said Mr. Binz is too “anti-carbon” for him.

Both are members of the Senate Energy and Natural Resources Committee, which is split with 12 Democrats and 10 Republicans. All of the other Republicans are also expected to oppose Mr. Binz and with Mr. Manchin’s vote that leaves the nominee without majority support, which could bottle him up in the committee.

“After questioning Mr. Binz in yesterday’s Energy Committee hearing, it is clear that we have completely different views on how to effectively invest in America’s energy future — a future that I believe relies on clean, reliable and affordable energy,” Mr. Manchin said in a statement.

For his part Mr. Heller said he wasn’t convinced Mr. Binz agreed with the need for “an all-of-the-above approach to energy.”

Mr. Heller’s opposition is noteworthy because he seatmates with Senate Majority Leader Harry Reid, Nevada Democrat, and Mr. Binz has been aided in his confirmation bid by two lobbyists who used to work for Mr. Reid.

Mr. Binz, the former chairman of the Colorado Public Utilities Commission, had a rocky confirmation hearing on Tuesday, trying to explain his previous statement that natural gas was a “dead end” as a fuel, and to defend his use of a team of lobbyists and public relations strategists paid for by green technology interests in his effort to win confirmation.

Sen.Manchin Says Obama's Coal Policy's Beating The Crap Out His State (Too Late Joe You Helped To Elect Him)

West Virginia knew what it was doing when it overwhelmingly voted against President Obama in the recent election, they were trying to save their jobs. The number two coal mining state in the country knew that the President's energy policy has a goal of killing the coal industry. Well not everybody in the state knew. West Virginia Democratic Senator Manchin woke up this morning and realized that the president he helped to elect is anti-Coal.

Manchin exploded over the Obama administration’s anti-coal policies during a senate hearing today. 
We’re getting the living crap beaten out of us, there has been nothing more beat up than coal.
Manchin voiced his frustrations with rules put forward by Obama’s Environmental Protection Agency which have made it more costly and difficult for coal plants and coal mines to operate. 
They just beat the living daylights out of little West Virginia, but they sure like what we produce,” Manchin added. “We could do it a lot better if we had a government working with us as a partner. 
Manchin’s remarks were made while questioning Ron Binz, Obama’s nominee to head up the Federal Energy Regulatory Commission, which regulates electric grids, gas pipelines, natural gas export terminals and hydroelectric power plants.
Hopefully come election time, West Virginia voters will remember that Joe Manchin helped to elect the guy who put them out of business.  Especially when one considers it is about to get much, much, worse.
This week, the EPA is expected to finally release its New Source Performance Standards (NSPS), which will set emissions standards not just for the construction of future power plants, but for existing ones also.

LANDMARK FEDERAL STUDY: NO INDICATION FRACKING CONTAMINATES DRINKING WATER

PITTSBURGH (TheBlaze/AP) — A landmark federal study on hydraulic fracturing, frequently referred to as fracking, shows no evidence that chemicals from the natural gas drilling process moved up to contaminate drinking water aquifers at a western Pennsylvania drilling site, the Department of Energy told The Associated Press.
After a year of monitoring, the researchers found that the chemical-laced fluids used to free gas trapped deep below the surface stayed thousands of feet below the shallower areas that supply drinking water, geologist Richard Hammack said.
Although the results are preliminary – the study is still ongoing – they are a boost to a natural gas industry that has fought complaints from environmental groups and property owners who call fracking dangerous.
Drilling fluids tagged with unique markers were injected more than 8,000 feet below the surface, but were not detected in a monitoring zone 3,000 feet higher. That means the potentially dangerous substances stayed about a mile away from drinking water supplies.
“This is good news,” said Duke University scientist Rob Jackson, who was not involved with the study. He called it a “useful and important approach” to monitoring fracking, but cautioned that the single study doesn’t prove that fracking can’t pollute, since geology and industry practices vary widely in Pennsylvania and across the nation.
The boom in gas drilling has led to tens of thousands of new wells being drilled in recent years, many in the Marcellus Shale formation that lies under parts of Pennsylvania, New York, Ohio and West Virginia. That’s led to major economic benefits but also fears that the chemicals used in the drilling process could spread to water supplies.

‘Democratic’ and ‘Anti-Business’ Are Becoming Synonymous


Forbes’s recently released list of “The Best States for Businesses and Careers” provides further evidence of the Democratic party’s striking erosion as a party of economic growth and prosperity.  Based on their votes in the most recent presidential election, all but three of Forbes’s top-10 states are Republican-leaning, while all but two of its bottom-10 states are Democratic-leaning.

The top-10 states on Forbes’s list — Utah, Virginia, North Dakota, North Carolina, Colorado, Nebraska, Texas, Georgia, Oklahoma, and Iowa — voted for Mitt Romney by an average margin of 14 percentage points.  Meanwhile, the bottom-10 states on Forbes’s list — California, Wisconsin, New Mexico, Vermont, West Virginia, Mississippi, Michigan, Hawaii, Rhode Island, and Maine — voted for President Obama by an average margin of 13 points.  That’s a 27-point swing from Romney to Obama as we move from the top-10 states to the bottom-10 states.
Forbes rated the states based on six factors: “business costs,” “labor supply,” “regulatory environment,” “economic climate,” “growth prospects,” and “quality of life.”  Forbes rated 62 percent of Obama’s states as being below average and 63 percent of Romney’s states as being above average.  Obama won only 33 percent of Forbes’s top-15 states but 73 percent of its bottom-15 states.

Report: More than 200 coal-fired generators slated for shutdown


Within the next three to five years, more than 200 coal-fired electric generating units will be shut down across 25 states due to EPA regulations and factors including cheap natural gas, according to a new report by the American Coalition for Clean Coal Electricity (ACCCE).
“This is further evidence that EPA is waging a war on coal, and a war on affordable electricity prices and jobs. EPA continues to ignore the damage that its new regulations are causing to the U.S. economy and to states that depend on coal for jobs and affordable electricity,” said Mike Duncan, president and CEO of ACCCE, in a statement.
However, ACCCE notes that EPA policies may have played a role more than 4,800 megawatts of announced closures not included on in their report which would bring total shutdowns to 241 coal generator in 30 states — more than 36,000 MW of electric generation or 11 percent of the U.S. coal fleet.
The most affected states include Ohio, Pennsylvania, West Virginia, Virginia, and North Carolina, which will see a combined 103 coal-fired generators shut down.
“Actually our utility rates are higher and the impact is such that it’s going to interfere with the quality of life that a lot of individuals have in my community,” said John McNeil, mayor of Red Springs, N.C., in an ACCCE video — one of the heavily affected states.
According to ACCCE, coal provides more than half of North Carolina’s power. Poorer areas, like Red Springs, where a number of residents are on fixed income or live below the poverty line, are adversely affected by higher electricity bills because they eat up a greater portion of their income.
“During my lifetime, Red Springs has gone through some fairly significant changes. We don’t have the large textile plants which provide employments opportunities for many people. We’ve just shifted away,” said John Roberts of John’s Fuel Service, also in Red Springs.
