15 States Finally Standing Up Against Obama’s Unconstitutional Regulations


Fifteen State Attorney Generals have filed suit against Obama’s Environmental Protection Agency for their sweeping and unconstitutional carbon regulations.

The fifteen states who petitioned the court on Thursday are West Virginia, Alabama, Arkansas, Florida, Indiana, Kansas, Kentucky, Louisiana, Michigan, Nebraska, Ohio, Oklahoma, South Dakota, Wisconsin and Wyoming.

If you are like me, you are wondering where your state is in the list.

The Blaze reports that under the unconstitutional regulations, the EPA will “regulate the electricity industry and require states and utility companies to meet goals, providing rewards and penalties.”
EPA spokeswoman Liz Purchia told Reuters, “To ensure that the Clean Power Plan’s significant health benefits and progress against climate change are delivered to all Americans, EPA and the Department of Justice will vigorously defend it in court.”

Fine, but you have no constitutional authority to do so.

West Virginia Attorney General Patrick Morrisey said, “This rule is the most far-reaching energy regulation in the ... to transform itself from an environmental regulator to a central planning agency for states’ energy economies. The Clean Air Act was never intended to be used to create this type of regulatory regime, and it flies in the face of the powers granted to states under the U.S. Constitution.”
The attempt by the states could be more easily dismissed through nullification of EPApolicies, since they are not even law and since the EPA is an unconstitutional agency. However, something had to be done immediately.

“If we were to wait on the EPA to get this rule published, it could be well into 2016 before the States complete arguments and receive a ruling on a request to stay this rule,” Attorney General Morrisey said. “By that time, many states will already be in the middle of drafting their compliance plans ahead of the September 2016 deadline. We want to ensure that no more taxpayer money or resources are wastefully spent in an attempt to comply with this unlawful rule that we believe will ultimately be thrown out in court.”

“While this request is not typical, the EPA is playing games by putting the risk of a delay in publication entirely on the states,” Morrisey added. “We hope the court will spare our states any more unnecessary harm, and that the EPA will not needlessly delay the publication date.”

Of course, Barack Obama, being the Marxist that he is, called the unconstitutional measures “the single most important step the U.S. has ever taken to fight climate change.”

The problem is that there is no climate change. There is no global warming. All of this is false science in order to extort money from the American people, impose communism inAmerica, shutdown business and eventually control the people.

“This is one of those rare issues because of its magnitude, because of its scope, that if we don’t get it right, we may not be able to reverse it,” Obama said. “There is such a thing as being too late when it comes to climate change. That doesn’t mean it’s hopeless. We can take action.”

The problem is that men do no create the weather or change the climate. God does. He determines how far the seas go (Job 38:8-11) and how hard the winds blow (matt 4:39). Yes, even hurricanes, tempests and such are at His command. Climate change is nothing more than a ruse. It is a lie because it comes from those whose father is the father of lies (John 8:44), the devil.

It’s long past time that states began to start banding together to ignore, not go to court with, the federal government in matters like this. Furthermore, they should ignore the court’s ruling, which is just that (ie. A ruling), and begin nullifying and interposing themselves between citizens, businesses and other entities in the states and the federal government.

Better yet, why don’t we simply band together to eliminate the federal government altogether and go back to sovereign states and Articles of Confederation. That would eliminate much of the tyranny that is strangling us today.

Indiana Gov. Mike Pence Signs Bill Mandating Aborted Babies Must be Buried or Cremated

Pence today ceremonially signed a measure authored by State Sen. Liz Brown (R-Fort Wayne) ensuring all health-care facilities, including abortion clinics, appropriately dispose of the bodies of babies killed in abortions.

The new law would essentially disallow the kind of sale of aborted babies and their body parts that Planned Parenthood facilities in other states have been caught arranging. Although roe v. Wade prohibits states from banning abortions, pro-life advocates in Indiana believe the aborted baby ought to at least be treated respectfully even if the abortion clinic treated the baby with disrespect before the abortion.

The aborted fetal remains bill (SEA 329), establishes rules as to how abortion facilities must dispose of aborted babies and allows the pregnant woman to choose a different method at her own expense (i.e. burial). As testimony revealed, the Indianapolis Planned Parenthood facility was disposing of aborted babies down a drain into the sewer system, the Indiana State Department of Health (ISDH) implemented emergency disposal rules on July 1.


After national controversy surrounding the Planned Parenthood abortion businesses’ sale of aborted babies and aborted baby body parts, Indiana Governor Mike Pence today signed into law a new measure mandating that aborted babies must be buried or cremated.

Mike Pence, Indiana governor, says he’ll defy Obama’s carbon regulations

Indiana Gov. Mike Pence said Wednesday he will not comply with the Obama administration’s proposal to limit carbon emissions from existing power plants, the centerpiece of the president’s climate-change agenda.
In a letter to President Obama, Mr. Pence demanded that major changes be made to the plan. If those changes are not made, the governor said his state will defy the Environmental Protection Agency regulations, formally known as the Clean Power Plan.
“If your administration proceeds to finalize the Clean Power Plan, and the final rule has not demonstrably and significantly improved from the proposed rule, Indiana will not comply. Our state will also reserve the right to use any legal means available to block the rule from being implemented,” Mr. Pence said in the letter. “Energy policy should promote the safe, environmentally responsible stewardship of our natural resources with the goal of reliable, affordable energy. Your approach to energy policy places environmental concerns above all others.”
The final version of the Clean Power Plan is expected to be released in August. It would dramatically limit carbon emissions from power plants, and the EPA estimates overall U.S. carbon emissions would fall dramatically as a result of the plan.
The agency also admits that the amount of American energy generated by coal would fall by 25 percent after the plan is implemented.
Energy companies and a coalition of states already have challenged the plan in court, but the lawsuit was deemed premature and ultimately was dismissed. Opponents have vowed to file new lawsuits after the final plan is unveiled.

Indiana school district bused only black third-graders to tour local colleges

An Indiana public school district segregated elementary field trips last week when administrators included only African-Americans on the college introduction tour.
According to ABC 57South Bend Community Schools Corporation has planned a series of field trips to three local colleges for black third-graders in seven school districts. The excursions began last week with a trip to Ivy Tech Community College.
"I feel like all kids should be going."    
Dr. G. David Moss, the director for the African-American student-parent services with the South Bend Community Schools Corporation, told ABC 57 that he wanted the third-grade students to begin to think of themselves attending college.
“I was hired to look at the issues facing African-American kids in the South Bend Community Schools Corporation and my job specifically says that I need to develop programs and develop strategies to help these kids and their families become more successful academically,” Moss said.
However, many families, including those with children who can attend the field trips, said the field trips were exclusionary and discriminatory in nature.
“I feel like all kids should be going,” Deirdra Mullings, a mother of a child on the field trips, told ABC 57.
“It creates a double standard,” Kelley Garing told the news outlet.

Politico's Kelsey Snell Sloppily Decries Indiana's Economic Progress, Supposedly at the Expense of Illinois

Kelsey Snell "is a tax reporter at POLITICO Pro." Her output in a column entitled "Indiana lures 'Illinoyed' biz with tax breaks" makes one wonder how she arrived at her current position.
Snell's piece is riddled with striking omissions and lame progressive talking points. But the most jaw-dropping element in her report is her clear inability to detect erroneous numbers which she and her employer should know make no sense.
One of Snell's paragraphs has two obvious whoppers (bolds are mine throughout this post):

When (Indiana Commerce Secretary Victor) Smith, a former manufacturing executive, was appointed in January he was given one goal from Pence—adding 2,609,000 private sector jobs. He said the state has added 22,000 jobs since January, though he acknowledged he has a long way to go.
C'mon, Kelsey. The Hoosier State's total seasonally adjusted private-sector employment was only 2.545 million as of November. Smith's goal is obviously not to double employment; it's probably to raise it by 260,000. No one at Politico has detected this obvious blunder since the article's publication early Saturday evening.
Additionally, Snell's "22,000 jobs" figure is vastly understated. (If Smith said it, which I tend to doubt, Snell still should have verified it). The state has added 50,800 seasonally adjusted jobs since January. That's basically on track to achieve Pence's presumed 260,000-job, four-year goal.
As to omissions, let's start with the unmentioned fact that Indiana became a right to work state in February 2012 during the administration of Republican Mitch Daniels. Since then, the state has added 89,300 payroll jobs, with 80,000 of them in the private sector. During that same period, Illinois, whose workforce is over twice as large, has added proportionally fewer jobs.
Snell never brought up unemployment rates. Indiana's seasonally adjusted rate since Republican Mike Pence took office in January has fallen from 8.6 percent to 7.3 percent. The rate in Illinois is still 8.7 percent, barely down from January's 9.0 percent.

Dem Senator's Son Has Insurance Cancelled

featured-imgLittle more than a week after millions of consumers received health care cancellation notices, lawmakers in both parties are pushing legislation to redeem President Barack Obama's long-ago pledge that anyone liking their coverage will be allowed to keep it under the nation's controversial new law.

The result is a stern new challenge for the White House as it struggles to fix website woes for the signup portal for those seeking to enroll under the law, and simultaneously copes with angry consumers who rightly or wrongly blame "Obamacare" for cancellation letters mailed by insurers.

Democratic officials said top administration aides got a close-up view of the cancellation controversy last week, when Sen. Joe Donnelly, D-Ind., said at a closed-door meeting of the party's rank and file that his son had received notice his coverage was being terminated.

In response, these officials said White House Chief of Staff Denis McDonough referred to a speech Obama had made earlier in the week saying some of those losing coverage would qualify under Medicaid, some would receive federal subsidies for individual coverage, and others would have options in the so-called exchanges the law set up to allow individuals to shop for insurance. Donnelly's office declined several requests for comment. The officials who described the incident did so on condition of anonymity, saying they were not authorized to discuss a private meeting.

[VIDEO] Obamacare Costs One Indiana School District $6 Million

Obamacare is costing one Indiana school district $6 million, WTHI reports:
"In the past, we've told you about the new federal healthcare law and how small business and local governments have been hit," said the anchor. "The next area affected by the law could be education."
The reporter adds, "The affordable care act has had its proponents as much as it's had its opponents. In the last few months we've heard different stories from private and government employers on the cuts, they've had to make. However, in Vigo county some of those cuts will come at the cost of education."
"So what we had to do the other evening at the board meeting was to cut worker's hours to below 30 because we cannot afford to offer health care to every employee," says the superintendent
It would cost $6 million a year to provide health care to every employee who works more than 30 hours, says the superintendent.

Obamacare causing Indiana city to pay 40% MORE for health insurance for city govt employees…

So Obamacare isn’t just going to raise individual and employer health care costs, but also for cities as well — in this case the city of Sullivan, Indiana. So not only might you be paying increased costs for your own health care, but Obamacare may require more of your tax dollars as well to pay for increased cost for city and state employees, and that’s not counting the federal or state subsidies either.

Pence and The Revolution: Five reasons he might be the 2016 dark horse to watch

He’s more charismatic than Scott Walker, more conservative than Chris Christie and, unlike so many of the top-tier 2016 Republicans, he has actually run a state.
So why isn’t Indiana Gov. Mike Pence generating the kind of buzz worthy of a top-tier candidate?
Probably because while his opponents have been show horses, he’s been a work horse. And that makes him a dark horse.
Here are five reasons why we should take Pence’s chances very seriously:
1. The résumé’ - “[A]s a former congressman and now a governor, [Pence] has garnered that hard-won ‘two-fer’ status, thus giving him a very credible résumé,” says Cheri Jacobus, a GOP strategist.
Being a governor is important for a variety of reasons, both substantive and symbolic. Before becoming a governor, “Mike Pence’s policy bandwidth consisted of tax cuts,” said one strategist. “But…when you’re a governor, you’re actually in charge of running things.”
Of course, merely being a governor isn’t enough. You have to have governed effectively, and that’s just what he’s done. “Pence comes from a state that is a success story. It’s actually gaining industrial jobs. It’s a right-to-work state now,” added the strategist.
Aside from work experience, it also helps to have had life experience — and a compelling story to tell. Again, Pence has that. “He is an evangelical Midwestern conservative who has the compelling family story to tell of his grandfather being an Irish immigrant who drove a bus in Chicago,” says John Dunagan, a public affairs executive who worked on the Bush-Cheney ’04 campaign.

The New Yorker’s Voting Myths Evidence shows that voter-ID laws are effective and fair.


The Left is committed to the false narrative that there is no voter fraud in the U.S. The latest article in the genre is Jane Mayer’s New Yorker piece “Voter-Fraud Myth.”

Like others before her, Mayer is convinced that efforts to assure the integrity of the electoral process are actually a right-wing conspiracy to suppress voter turnout. So when John Fund and I came out with Who’s Counting? How Fraudsters and Bureaucrats Put Your Vote at Risk, a book that details numerous cases of election fraud, it was an invitation to a journalistic hit piece.
To maintain her belief that voter fraud is rare, Meyer apparently turned a blind eye to the news stories breaking all around her, none of which she mentions in her story. In just the past month, we’ve seen:

the Democratic nominee for Maryland’s first congressional district removed from the ballot after it was discovered that she had registered and voted in both Maryland and Florida in the 2006 and 2008 elections;
an Arkansas legislator resigning after pleading guilty (with three other defendants) to committing voter fraud;
a Canadian couple and a Mexican citizen arrested for illegally registering and voting in Iowa;
a New Jersey resident convicted on multiple counts of voter fraud;
three Indiana residents (including a former Democratic mayoral candidate) indicted for voter fraud;
three Ohioans indicted for double voting;
a Mexican drug dealer’s guilty plea for voting illegally in the 2008 presidential election;
Florida’s discovery of nearly 200 non-citizens illegally registered to vote, and
a city-council race in Vernon, Calif., overturned owing to voter fraud.

While ignoring the slew of voter-fraud cases erupting across the country, Mayer focuses on just a few incidents that Fund and I cite in the book. Then she misreports them.

Pennsylvania Ripe for the Picking


Pennsylvania is approaching the Nov. 6 presidential election with 3 percent fewer registered voters than in fall 2008, an unusual slip that political analysts blame on a drop in voter enthusiasm across the country.
Democrats especially experienced a slump, bleeding 229,396 registered voters in Pennsylvania since the last presidential race, state data show. Republicans are down 112,796 registrants, but voters unconnected to either major party grew by 7 percent, or 73,043, according to Pennsylvania Department of State figures. As of Monday the state had 8,487,093 voters, down from 8,755,588 in November 2008, despite a 2 percent population gain. Democrats still hold a 50-37 percentage registration edge over Republicans, down one point from 2008.
The registration deadline for the election was Oct. 9.
“This year, we don’t have such a sense that this election is going to make history the way we did in 2008,” said Pat Dunham, chairwoman of the political science department at Duquesne University. “Enthusiasm in general may have dampened a little. Three-and-a-half years after electing Barack Obama, we see it’s not that easy to change things. ”
For Democrats in particular, “there’s not the same excitement” as four years ago, when the party tallied thousands of registrations, said political analyst Geoffrey Skelley of the University of Virginia Center for Politics.
“There are probably no states that have had incredible increases in voter registration” this time, Skelley said.
Swing states that are losing that status may experience declines in voter registration when candidate visits and advertising shift to areas more in play, political scientists said.
Pennsylvania, which typically votes Democrat for presidents, joined Michigan, Indiana and Missouri to become less of a swing state, said Keystone College professor Jeff Brauer.

Black pastor uses lynching photo to help get out the vote

A pastor in Indiana has put up a sign that uses a historical image of the 1930 lynching of two black teenagers in an effort to recharge the black vote. Rev. Joy Thornton, the senior pastor of Greater St. Mark Missionary Baptist Church in Indianapolis, said he’s concerned that African-Americans have grown complacent about voting, and he wants to urge people to exercise the right he says was hard won, the Associated Press reported.

The sign, which has stood for nearly a week along the street in front of the church, shows, on one side, a white mob gathered around the teens to watch the lynching in Marion, Ind. Atop the photo is the word “VOTE!!!” Beneath it is the question: “Is this a reason to vote?” The other side of the sign shows an image of slaves in chains, with wording beneath it that reads, “Lest we forget.”
“[The sign] is to let people know there’s been a price paid for the privilege of voting,” Thornton, a black pastor of what he describes as a multiracial congregation, told Indianapolis' WISH TV. “Oftentimes people get complacent and don’t realize that people made a sacrifice, matter of fact, the ultimate sacrifice for such a privilege.”
